preliminary approval, has achieved compliance with local zoning ordinances prior to the licensee <br />receiving final approval from OCM to commence operations. <br />According to Minnesota’s cannabis law, a local unit of government has 30 days to respond to this <br />request for certification of compliance. If a local government does not respond to OCM’s request <br />for certification of compliance within the 30 days, the cannabis law allows OCM to issue a license. <br />OCM may not issue the final approval for a license if the local government has indicated they are <br />not in compliance. OCM will work with local governments to access the licensing software system <br />to complete this zoning certification process. <br />Inspections & Compliance Checks <br />Local governments are permitted specific business inspection and compliance check authorities in <br />addition to—and not in conflict with—OCM authorities. The inspection and compliance check <br />portion of the code will go directly to the City Council. <br />Local Ordinance Creation <br />A local government may adopt a local ordinance regarding cannabis businesses. <br />• Local governments may not prohibit the possession, transportation, or use of cannabis, or <br />the establishment or operation of a cannabis business licensed under state law. <br />• Local governments may adopt reasonable restrictions on the time, place, and manner of <br />cannabis business operations. <br />• Local governments may adopt interim ordinances to protect public safety and welfare, as <br />any studies and/or further considerations on local cannabis activities are being conducted, <br />until January 1, 2025. A public hearing must be held prior to adoption of an interim <br />ordinance. <br />Recently, the OCM issued a model ordinance for local governments to consider; see Attachment <br />D. <br />Source used for background information: Minnesota Office of Cannabis Management – A Guide for <br />Local Governments on Adult-Use Cannabis <br />Neighboring Community Analysis <br />Several area communities were contacted about their organization's status in implementing <br />cannabis. Communities were asked questions about their community's approach toward the number <br />of allowable businesses, proposed zoning districts, and the buffer considered for <br />schools/daycares/parks etc. <br /> <br />Most communities have begun early internal discussions about cannabis implementation; however, <br />no formal action has been taken for most communities except for Vadnais Heights, which has <br />brought forth recommendations to its Planning Commission that were ultimately approved. Staff at <br />Vadnais Heights has indicated the topic of cannabis will be sent to the City Council next month for <br />consideration. <br />Community Overall Status <br />Arden Hills No formal action <br />Maplewood No formal action <br />New Brighton No formal action <br />Roseville No formal action <br />Shoreview No formal action <br />Vadnais Heights <br />The proposed Zoning Code in draft Ordinance 775 was <br />approved at the Planning Commission on 6/25/2024. Cannabis <br />will be considered at City Council next month.
