MINUTES <br />CITY COUNCIL <br />JULY 22, 2009 <br />The City Administrator reported that the City Attorney has prepared a <br />draft resolution granting the Interim Use Permit which outlines the <br />findings of fact and the condition that the Frattalone's enter into the IUP <br />Agreement with the City. <br />The Administrator pointed out that based on future market conditions, <br />there is the possibility that the Frattalone's will request an extension of the <br />IUP Permit again. <br />The Administrator indicated that should the IUP be approved this evening, <br />the City Attorney will then prepare the IUP Agreement. That Agreement <br />will be presented to the Council for approval at an upcoming meeting. <br />Frank Frattalone appeared before the Council and thanked everyone <br />involved for working through this process. He felt that the compromise <br />that was reached was a good one and will allow Fra-Dor to remain in <br />operation for a period of time while adva~icing the City's desires for <br />redevelopment of the site. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Keis, seconded by Boss, the public hearing was closed. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2009-7--165 - GRANTING AN INTERIM USE <br />PERMIT FOR AGGREGATE MATERIAL STOCKPILING AND <br />RECYCLING FOR FRA-DOR, 3137 COUNTRY DRIVE, LITTLE <br />CANADA, MINNESOTA SUBJECT TO FRA-DOR ENTERING INTO <br />AN INTERIM USE PERMIT AGREEMENT WITH THE CITY <br />WHICH WILL OUTLINE THE TERMS AND CONDITIONS OF THE <br />IUP <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />PUD PERMIT- Mayor Blesener opened the Public Hearing to consider an application for <br />3151 COUNTRY Plamred Unit Development Permit for outdoor storage consisting generally <br />DRIVE- of contractor equipment and materials for property at 3151 Country Drive. <br />COSTANZO Blesener noted that the Planning Commission recommended approval of <br />the PUD Permit conditioned that the applicant comply with the City's <br />current outdoor storage standards and bring he property into compliance <br />by November 30, 2009. If the property is not brought into compliance by <br />that date, the PUD Permit application would be deemed denied. <br />
