MINUTES CITY COUNCIL JULY 22, 2009 The City Administrator reported that the City Attorney has prepared a draft resolution granting the Interim Use Permit which outlines the findings of fact and the condition that the Frattalone's enter into the IUP Agreement with the City. The Administrator pointed out that based on future market conditions, there is the possibility that the Frattalone's will request an extension of the IUP Permit again. The Administrator indicated that should the IUP be approved this evening, the City Attorney will then prepare the IUP Agreement. That Agreement will be presented to the Council for approval at an upcoming meeting. Frank Frattalone appeared before the Council and thanked everyone involved for working through this process. He felt that the compromise that was reached was a good one and will allow Fra-Dor to remain in operation for a period of time while adva~icing the City's desires for redevelopment of the site. There was no one present from the general public wishing to comment on this matter. Upon motion by Keis, seconded by Boss, the public hearing was closed. Mr. Keis introduced the following resolution and moved its adoption: RESOL UTION NO. 2009-7--165 - GRANTING AN INTERIM USE PERMIT FOR AGGREGATE MATERIAL STOCKPILING AND RECYCLING FOR FRA-DOR, 3137 COUNTRY DRIVE, LITTLE CANADA, MINNESOTA SUBJECT TO FRA-DOR ENTERING INTO AN INTERIM USE PERMIT AGREEMENT WITH THE CITY WHICH WILL OUTLINE THE TERMS AND CONDITIONS OF THE IUP The foregoing resolution was duly seconded by McGraw. Ayes (4). Nays (0). Resolution declared adopted. PUD PERMIT- Mayor Blesener opened the Public Hearing to consider an application for 3151 COUNTRY Plamred Unit Development Permit for outdoor storage consisting generally DRIVE- of contractor equipment and materials for property at 3151 Country Drive. COSTANZO Blesener noted that the Planning Commission recommended approval of the PUD Permit conditioned that the applicant comply with the City's current outdoor storage standards and bring he property into compliance by November 30, 2009. If the property is not brought into compliance by that date, the PUD Permit application would be deemed denied.
