MINUTES <br />CITY COUNCIL <br />JULY 22, 2009 <br />BEVERLY traffic citations legislation. Representative Scalze also secured funding <br />SCALZE for the State to begin to evaluate he effects of coal tar sealants on city <br />storm water systems. The Mayor and Council congratulated <br />Representative Scalze on this recognition. <br />BOY Mayor Blesener acknowledged the attendance of Boy Scout Ryan Miller <br />SCOUT at the Council meeting. Miller indicated that he was in attendance as he <br />RYAN MILLER is working toward a merit badge. <br />INTERIM Mayor Blesener opened the continuation of Public Hearing to consider <br />USE PF,RMIT- the reissuance of an Interim Use Permit allowing aggregate materials <br />3137 COUNTRY stockpiling and recycling at Fra-Dor, 3137 Country Drive. <br />llKIVE- <br />FRA-llOR The City Administrator reported that the Fra-Dor Interim lJse Permit <br /> expires on September 30, 2009. Over the past several months a <br /> subcommittee representing the City has been working with Fra-Dor on the <br /> redevelopment of The site. That subcommittee is comprised of Council <br /> Members Keis and Montour, and Planning Commissioner Tom Duray. <br /> Given the state of The economy, it is unlikely that redevelopment will <br /> occur in the immediate future. Therefore, a compromise has been worked <br /> out wherein the Fra-Dor operation would be allowed to continue to <br /> operate for a period of five years subject to conditions entering into an <br /> Interim Use Permit Agreement with the City. That agreement will outline <br /> key conditions, and the City Administrator noted the conditions as <br /> outlined in his report dated July 7, 2009, and as discussed by the Council <br /> at their workshop meeting on July 8, 2009. Some of the key conditions <br /> include: <br />• A flue-year extension of the IUP; <br />• The property will be put up for sale in three years; <br />• Sale price will be based on an independent appraisal done <br />by an appraiser that is mutually agreed upon by the <br />Frattalone's and the City; <br />• Redevelopment of the site is potentially with seven 5,000 to <br />6,000 square foot buildings or three 40,000 square foot <br />buildings; <br />• There is the potential for including additional property in <br />the redevelopment process; <br />• Water and sewer systems to be extended along Ryan Drive. <br />The City Administrator noted the IUP Agreement terms will be somewhat <br />fluid based on market conditions. He noted the excellent cooperation on <br />the part of the Prattalone's in reaching this compromise, noting the City's <br />ultimate goal to get the property redevelopment, while maintaining a <br />viable business and employment base in current market conditions. <br />
