MINUTES <br />CITY COUNCIL <br />JULY 22, 2009 <br />THE FINDING THAT THE PUD PERMIT AS REQUESTED DOES <br />NOT COMPLY WITH THE CITY'S CODE REQUIREMENTS <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The Council noted that the property would be subject to its existing PUD <br />Permit, and indicated that if the applicants wish to request a <br />reconsideration of the PUD Permit request just denied, they should do so <br />at the August 12, 2009 Council meeting. <br />TEXT Blesener opened the Public Hearing to consider a request for a Text <br />AMENDMENT Amendment allowing manager/caretaker apartments for self-storage <br />& CUP - facilities by Conditional Use Permit in the B-3 Zoning District as well as <br />2617 PARK a Conditional Use Permit for the use and occupancy of amanager/ <br />STREET - caretaker apartment at the Little Canada Mini-Storage facility at <br />LITTLE 2617 Park Street. It was noted that the Planning Commission <br />CANADA recommended denial of the Text Amendment and CUP, but suggested <br />MINI-STORAGE that Mr. Ed Jablonski be allowed to occupy the apartment until December <br /> 31, 2009. <br />The City Administrator reported that the attorney representing Little <br />Canada Mini-Storage and Mr. Jablonski submitted a letter of withdrawal <br />for the Text Amendment and CUP requesting that Mr. Jablonski be <br />allowed to occupy the apartment until December 31, 2009 as the Planning <br />Commission recommended. <br />Blesener asked the City Planner to review generally the allowed used in <br />the B-3 District. "the City Planner reported that uses allowed in the B-3 <br />District are generally retail and office in nature. The Planner also noted <br />that residential uses are not allowed in the B-3 District. He indicated that <br />the mini-storage use is historically awarehouse/industrial-type use. 'The <br />Little Canada Mini-Storage is a lega]ly non-conforming use in its present <br />location. <br />There was no one present from the general public present wishing to <br />comment on this matter. <br />Upon motion by McGraw, seconded by Keis, the public hearing was <br />closed. <br />The Council acknowledged receipt of the written withdrawal of the <br />application for Text Amendment and Conditional Use Permit received <br />from David 'Thoelke, attorney representing Little Canada Mini-Storage <br />and Edward Jablonski, dated July 20, 2009.
