MINUTES <br />CITY COUNCIL <br />JULY 22, 2009 <br />to allow Mr. Jablonski to occupy the property until December 31, 2009, at <br />which time he must move from the mini-storage and the space can no <br />longer be used for residential purposes. <br />PUD PERMIT- Blesener opened the Public Hearing to consider allowing a PUD Permit <br />2968 RICE allowing the interim use of commercial property for a private auto repair <br />STREET - hobbyist until such time as the property is sold as requested by Marilyn <br />MONTREUX Montreux for property located at 2968 Rice Street. <br />The City Planner reported that the PUD Permit for this interim use was <br />previously issued by the City and has now expired. The applicant has the <br />property for sale, but due to economic conditions, it has not sold. <br />Therefore, the applicant is requesting the hobbyist use be allowed to <br />remain until the property is sold. The Planner noted that City staff is <br />recommending issuance of another PUD Permit allowing the interim use <br />for a five year period or until the property is sold, whichever occurs first. <br />The property would also be subject to annual inspections to ensure that it <br />is Code compliant. "fhe Planning Commission supported the <br />recommendation of City staff. <br />McGraw noted asked if large trailers could be parked on the property. The <br />City Planner replied that they could not, noting that this would be <br />considered outdoor storage. McGraw indicated that he has observed a <br />large trailer on the property and asked if caps are being hauled in and out <br />of the site. Blesener noted that this is a hobbyist use, not a commercial <br />use. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-7-767-APPROVINGAPLANNED UNIT <br />DEVELOPMENT PERMIT ALLOWING AN INTERIM USE OF <br />COMMERCIAL PROPERTY LOCATED AT 2968 RICE STREET FOR <br />A PRIVATE AUTO REPAIR HOBBYIST FOR A PERIOD OF FIVE <br />YEARS OR UNTIL THE PROPERTY IS SOLD, WHICHEVER <br />OCCURS FIRST CONTINGENT UPON COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE CODE ENFORCEMENT OFFICER <br />OUTLINED IN HER REPORT DATED JULY 1, 2009 <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />
