The City Council can add additional restrictions such as: <br />1. Prohibiting the co-location of cannabis retailers with any residential. <br />2. Prohibiting the location of cannabis retailers next to any residentially-zoned or residentially <br />used property. <br />3. Specific regulations about the street the business should front (limiting it to Rice/other) <br /> <br />Because the City can add these additional regulations, Staff do not have a strong opinion on whether <br />retailers are permitted in the C-2 District. <br /> <br />Non-Retailers <br />As shown in the table above, City Staff would recommend limiting such activities to the I-1 district <br />for two reasons: <br />1. The areas zoned I-1 in the community are primarily bordering other industrial or <br />commercial. Many of the I-2 zoned properties are immediately next to existing and future <br />residences. <br />2. The properties zoned I-1 in Little Canada are typically older structures. Cannabis enterprises <br />have, in other States, had substantial capital resources. <br /> <br />Similar to the sale of retail, City Attorney Johnson does believe we could prohibit the location of <br />any such facility immediately adjacent to a residential property. She has also suggested requiring a <br />Conditional Use Permit or an Interim Use Permit for some or all cannabis business types. <br /> <br />Retail Registration Discussion: <br />• Determine the number of businesses with retail or retail endorsement allowed (the minimum <br />required is one per 12,500 residents. City Attorney Johnson provided clarity that the State is <br />currently enforcing this rule that 12,501 residents would require municipalities to permit two <br />(2) retailers. <br />• If a limited number, determine a process for how the license should be awarded <br />o First come first awarded; or <br />o Clear and measurable standards. <br />• Determine if buffers around specific uses are desired <br />o If buffers are desired, how large should the radius be? <br /> Staff recommends: <br />• A maximum of 500 feet from schools, daycares and public parks with <br />a playground and/or athletic facilities or fields <br />o FYI: Little Canada’s tobacco buffer is 500 feet from churches <br />and youth-oriented facilities and the liquor buffer is 800 feet <br />from schools and churches) <br />• Exclude Veteran’s Memorial Park and Gervais Mill Park since there <br />are no playgrounds or fields and the law specifically says attraction <br />within a park that is regularly used by minors <br />• Not allowed to co-locate with any residential use, immediately <br />adjacent to any residential use, including across the street (except <br />Rice Street) <br />• Determine registration fees <br />o Staff recommends the maximum amount allowed per state law <br />• Determine if hours of operation should be restricted further than state law: no sales between <br />2am – 8am Monday – Saturday and 2am – 10am Sunday <br />o Staff recommends further restricting hours <br /> FYI: Little Canada allows tobacco store hours 8am-11pm, 7 days per week <br /> <br />
