<br /> MINUTES <br /> City Council <br /> (Cont. <br /> <br /> May ..7_ 1980 <br /> Clarification The Council again discussed the McCumber anti Dahl license application. <br /> Of McCumber The Attorney pointed out that the City can make restrictions, but they <br /> & Dahl must not be arbitrary or capricious. <br /> Matter <br /> The Planner mentioned that the City should not have considered the <br /> license application until Mr. McCumber had completed his portion of <br /> the requirements pertaining to his building. The landscape bond was <br /> presented last month and a bid for the landscape was shown to the <br /> Planner by Mr. McCumber tonight. The Planning Commission denied the <br /> recommendation of aiissuance of a license. The letter presented <br /> tonight by Mr. Dahl was almost the same as his previous letter of <br /> April 1, 1980 except that he explains wheel alignment. Since there <br /> was no vote on the question to reconsider the auto repair license <br /> for Mr. Dahl, it was impossible for the Council to discuss the McCumber <br /> requirements. <br /> blm. Stenger Mr. A~illiam Stenger appeared before the Council explaining why his <br /> building on Centerville Road is set contrary to setback requirements. <br /> In his remarks he mentioned that one of his corner property stakes <br /> was removed and installed erroneously. The ditch (Ditch ##7) also <br /> caused problems with site locations. Fle was asked why he did not <br /> ask for a variance, to which he replied that he was assured it was <br /> not necessary. <br /> He also stated that he will settle the building set back encroachment <br /> matter with Mrs. Jenny Costa and request that the City not interfere <br /> in this matter. <br /> Mr. Stenger also informed the Council that a new tenant will be occupying <br /> a part of his building on Centerville Road and he intends to enlarge <br /> the parking lot. Ne was advised that the matter has to be reviewed <br /> by the Planning Commission and the City Council for approval. <br /> Adjourn Mr. Nadeau introduced the following resolution and moved its adoption: <br /> RESOLUTIODI N0. 80-5-163 - ADJOURNING <br /> The foregoing resolution was duly seconded by Mr. Fahey. <br /> ayes Nadeau, Fahey, Scalze, Hanson. <br /> Nay es (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Booi< No. 6, Page 105. <br /> There being no further business, 'the meeting was adjourned. <br /> Respectfully submitt/ed,/ <br /> ~'osep~ G" Chlebeck <br /> City Clerk <br /> Page -n- <br /> <br />
