<br /> CITYTCOUNCIL <br /> July 9, 1980 <br /> Cable TV Attorney Parks informed the Council that he has reviewed 'the Joint <br /> Powers Agreement the City is being asked to sign with regard to <br /> Cable TV. Parks stated that the agreement appears to be in order, <br /> and recommends the City enter into the agreement if it is interested <br /> in Cable TV. <br /> Mr. Tarnowski, chairman of the City's Cable TV committee informed <br /> the Council that the committee has done a needs assessment for the <br /> City on cable TV. The assessment was done through a questionnaire <br /> that was sent to citizens of Little Canada. <br /> Mr. Tarnowski informed the Council that by entering into the Joint <br /> Powers Agreement the City will participate in a Commission that will <br /> handle the question of Cable TV for the ten surrounding cities. Little <br /> Canada will have two votes on this Commission. It will cost the <br /> City $1,000 per vole to participate in the Commission. The purpose <br /> of the Commission is to get the franchise process started for the <br /> participating cities. <br /> Mr. Tarnowski informed the Council that all monies the City spends <br /> will be refunded to the City once the franchise is awarded. <br /> Mr. Tarnowski also recommended to the Council that once the Committee <br /> submits its final report the Committee should be disbanded. <br /> Mr. Tarnowski also informed the City that once the franchise is awarded <br /> the City will receive 3% of the profits the franchisee makes. This <br /> money will go directly into the General Fund. A 5% fee would be possible <br /> for the City, however, then some of these monies would have to go into <br /> programming. The monies will go through the Cable TV Commission and <br /> they will divide the money between the participating cities. <br /> Mr. Tom Crayton informed the Council that the Commission will need a <br /> 2/3 vote in order for anything to be passed. In that way, New Brighton <br /> and Roseville, who have the majority of the votes on the Commission, <br /> will not be able to decide policy just through their votes. Mr. Crayton <br /> also recommended to the City that it retain its franchise granting powers. <br /> In that way the Cable TV Commission will have to ~ ease all 10 cities <br /> in granting the franchise. <br /> Councilman Fahey stated that he would like the City to have complete <br /> control over who receives the franchise. As Fahey understands, there <br /> is a lot of difference between the quality of Cable TV franchisees. <br /> Fahey stated that he would like the highest quality of company involved <br /> and not one that deals with smut. <br /> Mr. Nadeau introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-7-253 - ENTERING INTO THE CABLE TV <br /> JOINT POWERS AGREEMENT <br /> The foregoing resolution was duly seconded by Mr. Hanson. <br /> Ayes (4) Fahey, Nadeau, Hanson, DeBace. <br /> Nayes (0).
