<br /> MINUTES <br /> City Council <br /> September 8, 1980 <br /> Mr. Paisley stated that he still feels that a $9,000.00 assessment on <br /> 107 foot lot does not benefit the property to that extent. <br /> The Attorney stated that the City does not need uniformity on assessments. <br /> There may be unique parcels which the City must take into consideration. <br /> However, Parks pointed out that the City has an appraisal from a professional <br /> appraiser which stated that the property is benefited by that amount. <br /> Mr. Parks also commented that Mr. Paisley could sell part of his property <br /> to make up the cost of the assessments. <br /> Mr. Fahey suggested that perhaps the City could assess Mr. Paisley the <br /> equivalent of two 75 foot lots. <br /> Councilman Nadeau asked what the justification would be in doing this. <br /> Nadeau stated that everyone pays more for a larger lot. Mr. Nadeau <br /> stated that Mr. Paisley has the option of selling a lot. <br /> Councilwoman Scalze stated that she felt the City could not do this unless <br /> it was done for everyone. <br /> Mr. Paisley asked the Council about the possibility of a hardship deferment. <br /> Councilman DeBace stated that the Council did grant a hardship deferment <br /> on South Owasso Blvd. The Council deferred the assessment in this case, <br /> but added so much of the assessment back on the roll each year. Councilman <br /> DeBace stated that the Council would have to look at the individual case. <br /> Mr. Nadeau introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-9-336 - CLOSING THE PUBLIC HEARING ON <br /> IMPROVEMENT N0. 79-1 <br /> The foregoing resolution was duly seconded by Mrs. Scalze. <br /> Ayes (5) Nadeau, Scalze, Fahey, Hanson, DeBace. <br /> Hayes (O). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 220. <br /> Mayor Hanson pointed out that the assessment for the 58 feet of the Mumm <br /> property which fronts on Payne Avenue was calculated at $4,648.12. The <br /> City's appraiser determined that the benefit to the property from the <br /> improvement amounted to only $1,500.00. <br /> Councilwoman Scalze stated that the Mumm property is a double-fronting <br /> lot and that Mr. Mumm has access to his property from LaBore Road. <br /> Mr. Mumm does not need access from Payne Avenue. Mrs. Scalze stated <br /> that she felt the assessment should be deleted entirely. <br /> Councilman Nadeau stated that in the future it could be possible for <br /> Mr. Mumm to split that 58 feet of property and sell the lot. Nadeau <br /> suggested that the assessment of $4,648.12 be deferred until such time <br /> as this would occur. <br /> Councilman Fahey suggested that Mr. Mumm be assessed the $1,500.00 as <br /> the realtor suggests. <br /> Page -11- <br /> <br />
