<br /> MINUTES <br /> City Council <br /> November 5, 1980 <br /> The Attorney stated that it was doubtful that Shafer Construction could <br /> get the money released through legal action. However, the Attorney did <br /> say that the City would probably spend more than the $136.30 in attorney <br /> fees if Shafer Construction did take such action. <br /> Councilman Fahey suggested that the City pay Shafer Construction its <br /> final payment but withhold $136.30 from their payment pending the <br /> resolution of the Frattalone claim. <br /> The Attorney stated that the contractor's insurance company would not <br /> honor the claim. The City Clerk reported that this is true because the <br /> contractor's deductible is more than $136.30. <br /> The City Clerk also informed the Council that the City has in the past <br /> withheld the amount of claims from a contractor's final payment. <br /> Mr. Fahey introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-11-x}13 - DECLARING THAT $136.30 BE WITHHELD FROM <br /> THE FINAL PAYMENT TO SHAPER CONSTRUCTION ASSUMING TFIAT ALL OTHER <br /> WORK PERFORMED BY SHAPER CONSTRUCTION IS SATISFACTORY AND <br /> WIThIHOLDING THIS $136.30 FOR AN INDEFINITE PERIOD OF TIME UNTIL THE <br /> FRATTALONE CLAIM AGAINST SHAPER CONSTRUCTION IS RESOLVED <br /> The foregoing resolution was duly seconded by Mr. DeBace. <br /> Ayes (5) Fahey, DeBace, Scalze, Hanson, Nadeau. <br /> Hayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Pages 267 and 268. <br /> November 19 Mr. Fahey introduced the following resolution and moved its adoption: <br /> Special <br /> Council RESOLUTION N0. 80-11-414 - CHANGING THE TIME OF THE NOVEMBER <br /> Meeting 19, 1980 SPECIAL COUNCIL MEETING FROM 5 P.M. TO 7:30 P.M. <br /> The foregoing resolution was duly seconded by Mrs. Scalze. <br /> Ayes (5) Fahey, Scalze, Hanson, DeBace, Nadeau. <br /> Hayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Book No. 6, Page 268. <br /> Adjourn Mr. Nadeau introduced the following resolution and moved its adoption: <br /> RESOLUTION N0. 80-11-415 - ADJOURNING <br /> The foregoing resolution was duly seconded Mrs. Scalze. <br /> /{yes (5) Nadeau, Scalze, Hanson, DeBace, Fahey. <br /> Hayes (O).
