<br /> MTNUTES <br /> CITY COUNCIL <br /> November 72, 1980 <br /> Variance Mr. Charles Johnson, an attorney representing Mr. Dennis Ryan, appeared <br /> Hearing before the Council. Mr. Johnson informed the Council that Mr. Ryan is <br /> For requesting a lh foot side yard set back variance for the construction <br /> Dennis of an attached garage on the east side of his home. <br /> Ryan <br /> Mr. Johnson stated that the City Planner, Northwest Associated Consultants, <br /> has submitted a report to the City recommending the denial of the variance <br /> request as no hardship is shown. <br /> Mr. Johnson stated that the soil in the area is such that pilings are needed <br /> for the buildings. Mr. ~hnson further stated that it has been suggested <br /> that the garage be constructed on the west side of the property. However, <br /> there are presently pilings on the east side of the house for the garage. <br /> Mr. Ryan had anticipated that the garage would be built on the east side <br /> of the house when he built the house. <br /> Mr. Johnson informed the Council that the garage was not included on the <br /> building permit at the time the permit was taken for the house, but the <br /> subject of the garage was discussed. <br /> Mr. Ryan stated that there are enough pilings fora 3-car garage, but he <br /> would be building a 2-car garage. <br /> Mr. Johnson stated that according to the City's ordinance, there are no <br /> negative factors shown that would prohibit the variance requested by Mr. <br /> Ryan. Mr. Johnson stated that the economic factors involved due to the <br /> pilings would be the cause of a hardship. Mr. Johnson also stated that <br /> the neighbors do not object to Mr. Ryan's request. <br /> Mr. Johnson also stated that the Planner had some objection about the <br /> driveway Mr. Ryan proposed. Mr. Ryan would be willing to comply with <br /> the Planner's recommendations. Mr. Johnson also stated that on the west <br /> side of the house there is also a substantial amount of landscaping and <br /> trees planted that would be lost if the garage would be put on that side. <br /> Councilman Nadeau stated that he was against the variance being granted. <br /> Nadeau stated that it was too large a variance, and there is sufficient <br /> room on the west side of the house for the garage. Councilman Nadeau <br /> stated that Mr. Ryan should have looked into this before hand. <br /> Attorney Johnson stated that there was discussion about the garage at the <br /> time the permit was taken for the house. <br /> Councilman Fahey stated that he agreed with Mr. Nadeau. The City's ordinance <br /> puts the burden on the homeowner; the homeowner must show a hardship <br /> exists. Fahey also stated that the hardship must be due to the land and <br /> not due to economic factors. Mr. Fahey also stated that the Ramsey County <br /> Public Works Department is also opposed to the variance. They have <br /> plans for a bicycle lane in this area, and would go on the west side of <br /> the property. Fahey also commented that variances should not be freely <br /> granted. <br /> Page -9- <br /> <br />
