<br /> MINUTES <br /> CITY COUNCIL <br /> December 10, 1980 <br /> ORDINANCE N0. 171 - AN ORDINANCE AMENDING THE LITTLE CANADA <br /> CODE BY ADDING CHAPTER 2801 NOISE ORDINANCE WITH TFIE CHFlNGES <br /> RECOMMENDED BY TFIE PLANNING COMMISSION blHICH CONFORMS ThIE <br /> FIOURS OF OPERATION IN THE SNOWMOBILE ORDINANCE AND AMENDING <br /> SECTION 2801.090 REGARDING THE HOURS OF OPERATION OF RUBBISH <br /> HAULERS TO PROVIDE THAT THEY WILL BE UNRESTRICTED UNLESS <br /> A PUBLIC NUISANCE IS CREATED <br /> The foregoing ordinance was duly seconded by Mr. Hanson. <br /> Ayes (5) Fahey, Flanson, DeBace, Scalze, Nadeau. <br /> Hayes (0). <br /> Ordinance declared adopted. <br /> Magazine Some City Council members have received complaints about the displaying <br /> Problems of adult-magazines at 'the Tom Thumb store. <br /> At Tom <br /> Thumb The City Attorney visited Tom Thumb and Attorney Parks stated that he did <br /> not see a problem with the way the magazines are displayed. All of the <br /> magazines are wrapped in celophane to prevent people from looking through <br /> the magazines and some have non-transparant wrappers. <br /> Councilwoman Scalze stated that the problem was that a couple of the <br /> magazines are displayed in a stand right near the cash register and <br /> when standing in line at the check-out, children can't help but see <br /> the magazines. <br /> Parks stated that those racks have aboard in front of them so that you <br /> can't see the picture on the magazine. <br /> Mrs. Scalze stated that apparently one of these boards is missing. Mrs. <br /> Scalze also suggested that management would probably not be against <br /> moving these magazines near the check-out to the back of the magazine <br /> rack as the other adult-magazines are displayed. <br /> Several Council members stated that they would speak to the manager of <br /> Tom Thumb and make this suggestion. <br /> Dennis Attorney Parks reported that he received a letter from Mr. Charles Johnson, <br /> Ryan the attorney representing Dennis Ryan. Mr. Parks stated that in looking <br /> Variance over the minutes of the meeting he feels the Council was within its rights <br /> in denying Mr. Ryan a variance. Parks did say that the situation could <br /> be considered a hardship because of the soil conditions of the property <br /> and the existence of pilings on one side of the house, <br /> Mayor Hanson stated that the Planning Commission recommended the denial of <br /> this request as the size of the variance was very large, and the.City has <br /> correspondence from the Highway Department that they are planning bike paths for <br /> the area. Flanson also stated that the original plan of the house did not <br /> indicate a garage. Also the pilings were on the property before the house <br /> was even considered. <br /> Page -5- <br /> <br />
