r~zNUrEs <br />City founcil <br />February 11, 1981 <br />The foregoing resolution was du7y seconded by Mrs. Narclini, <br />qyes (5) Scalze, ~lardini, Hanson, Fahey, Forsberg, <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolut9on Book No. 7, Page 37. <br />PUD RPZOning Council opened the public hearing on the proposed rezoning of the Rocky <br />Hearing For Waite property located on the east side of R.uth Street from R-3 to <br />Rocky ulaite PUD zoning. Mr. Waite has requested this rezoning and the vacation <br />Property Qn of Lake Street that abutts the property so that he ca.n construct three <br />Ruth Street 4-plexes and two duplexes on the property. <br />Mrs. Scalze asked the Planner if the Council should be looking at who <br />the developer of the property will be. The Planner replied that at this <br />point it is not necessary. Any developer the Council will be dealing with <br />will have to comply with the terms of the PUI? agreement that would be <br />drawn up should the rezoning be approved. <br />Mrs, Scalze asked if the development would be Federally-funded housing. <br />Mr, Waite replied that it would not. <br />The Planner stated that the Council would just be approving the concept <br />of the land use tonight. There would not be the approval of any plans <br />at this point. <br />Mr. Waite informed the Council that the three 4-plexes and two duplexes <br />wou1d be rental units. Fl11 garages and parking would 6e at the back <br />of the property along the railroad tracks. Mr. Waite submitted to the <br />Council a list of property owners in the Canabury Square Condominiums <br />and informed the Council that all the people he talked to at Canabury <br />Square were not opposed to the development he is proposing. <br />Mr. Joe Morelan, a property owner on Ruth Street, appeared before the <br />Council and stated that he was opposed to Mr, k~aite's proposal. Mr. <br />Morelan felt the property should be down-zoned to R-1. <br />Mr. Fahey indicated that in April the Council will be considering the <br />zoning of the property along Ruth Street that is north of the 4Jaite <br />property, Fahey stated that he feels this property should be rezoned <br />to a PUD, and that the C.ity's ordinance would not preclude this. <br />The Planner informed Mr. Fahey that this would not be possible as a <br />PUD zoning is not in effect until there is a developer's agreement <br />for the property. The Planner stated that he is recommend~ng R-2 <br />zoning for this property with a PUD conditional use permit. <br />Mr. Harold Fiechert, a property owner on Jackson Street, appeared before <br />the Council. Mr. Fiechert informed the Council that he is not in favor <br />of any more multiple family housing in the area. Mr. Fiechert was also <br />concerned uiith the drainage in the area, and the traffic situation on <br />Jackson Street. <br />Page -2- <br />
