MINUTES <br />City Council <br />April 22, 1981 <br />Mr. Holmes informed the Council that the leg-hold trap is an effective <br />trap and not as dangerous as a rat trap. Also the City's proposed <br />ordinance says that certain types of wild animals not be taken. Mr. <br />Holmes indicated that cities do not have this authority. Cities can <br />restrict the types of devices that are used, but not certain animals <br />that can be taken. <br />Mrs. Scalze indicated that the Bloomington ordinance restricts the types <br />of animals that can be taken. Mr. Ho7mes stated that the ordinance is <br />a strict ordinance, but also an illegal one. <br />Mr. Holmes indicated that the various trapping ordinances adopted by <br />cities are all different and this causes a problem with the interweaving <br />of State law. <br />Mr. Holmes also stated that it is a matter of opinion on what is a nuisance. <br />Mrs. Scalze informed Mr. Nolmes that according to Bloomington, their <br />ordinance is working for them. Mr. Holmes again commented that according <br />to the Attorney General the ordinance is illegal and he questioned <br />whether or not Bloomington was enforcing their ordinance. Holmes <br />stated that when an ordinance 9s not enforceable or workable, people <br />tend to ignore it. <br />Mr. Fahey stated that he woutd not want to pass an ordinance that is in <br />conflict with State law. Fahey asked Mr. Holmes if the DNR had a sample <br />ordinance it could submit to the City for their consideration. Mr. <br />Holmes replied that the DPIR did have a sample ordinance. <br />Mr. Pogreba, a resident of Beam Avenue, appeared before the Council. <br />Mr. Pogreba was 9n favor of the Council passing the proposed trapping <br />ordinance. Pogreba stated that there is a problem with trapping in <br />the area of Little Canada in which he 7ives. Pogreba stated that he <br />is having problems with trappers trespassing on his property and that <br />he has no way to prevent these trappers from trespassing. <br />Mr. Pogreba indicated that pelts are valuable and this is why people are <br />trapping. Pogreba felt the City needs a trapping ordinance to give some <br />protection to the isolated wildlife area the City has. Pogreba also <br />indicated that the City should not wait for the State's model ordinance <br />as the problems of Little Canada are different from the problems in <br />other communities in the State. This ordinance is something that is <br />needed for a populated area. <br />Mr. Fianson felt there were two sides to the issue. To give protection <br />to the private property owners, but also to a11ow the private property <br />owners the right to take care of a nuisance. <br />Mr. Roy French, a resident on Edgerton, stated that the Council shou7d <br />go along with the DNR's recommendations. French felt the DNR should be <br />a1lowed to do their job. <br />Mr. Ollie Becker, a resident on Flllen Flvenue, stated that the City's <br />proposed ordinance is a nuisance to the property owner, Mr. Qecker <br />felt that property owners with a problem should not have to get a permit <br />from the City to take care of a problem. <br />Pa9e -n_ <br />
