MINUTES <br />CITY COUNCIL <br />April 22, 1981 <br />The City Clerk asked if the name change would effect the City's designation <br />of the Free Press as its local newspaper. The City Flttorney replied that <br />it would not. <br />Mrs. Dlardini introduced the following resolution and moved its acioption: <br />RESOLUTION N0. 81-~-194 - ACCEPTING THE PROPOSAL OF MR. <br />GENE JOHNSON TO CHANGE TFIE NAME OF THE LITTLE CANADFl/ <br />VADNAIS HEIGHTS FREE PRESS TO TFIE NORTH SUBURBAN PRESS <br />The foregoing resolution was duly seconde~ by Mrs. Sca7ze. <br />qyes (5) Nardini, Sca1ze, Forsberg, fahey, Flanson. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Pages 128 and 129. <br />Post- The City Clerk reported that the agenda items regarding the Loschy <br />ponements property division and the Glasrud 1ate charges have been postponed. <br />City Mr. Richard McNamara of the McNamara Insurance Company appeared before <br />Insurance the Council to present a quotation for Public Officials Liability Insurance <br />Coverage coverage for the City. <br />Mrs. Scalze asked whether the recent Supreme Court decision regarding <br />Councilpersons not being held individually liable for their actions <br />on a council would effect the need for this type of coverage. Mr. <br />Parks stated that there are areas where it would be considered that <br />the Council exceeded the scope of its authority that a Councilperson <br />could be held liable for. <br />Mrs. Scalze asked if this type of coverage would protect the Council in <br />the event of a rezoning. The Attorney stated that it would. The At~orney <br />also fe7t ~t would be impossible to try to anticipate the types of <br />exposures the Council is subject to, as there are always new things <br />that come up. The Flttorney stated that everyone should be insured as <br />completely as possible, however, there is a point beyond which someone <br />can go because of cost. Parks stated that this is an expensive insurance <br />policy, but there has been more concern in this area in recent years. <br />Fahey state~ that the insurance policy was very expensive, Fl1so the <br />policy refers to "wrongfu7 act". Fahey was concerned that if the Council <br />rezoned some property, the insurance company wou1d claim that a wrongful <br />act was not committed as the Council has the authority to rezone. <br />Mr. Mc~lamara informed the Council that their biggest exposure is litigation. <br />Court costs run about $1,000 per day. Just the cost of attorney fees and <br />investigator fees would justify the cost of the policy. McNamara stated <br />that the more publicity lawsuits get, the more lawsuits there are. <br />McNamarastated that the policy would also cover any of the various <br />commissions of the City, such as the Planning Commission. <br />Page -9- <br />
