MINUTES <br />CITE' COUNCIL <br />OCTOBER 23, 2024 <br />rezoning. He stated that the Planning Commission reviewed the requests at its October meeting and <br />unanimously recommended approval as presented. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />Larry Anderson, 2545 Rice Street, asked if Ramsey County approved the median for Rice Street, The <br />Community Development Director replied that the County is currently reviewing the most recent plans <br />from the applicant, specifically related to the right-of-way improvements and will provide comments <br />no later than October 30tn <br />Mayor Fischer acknowledged that the median would drive the right-in/right-out access for the <br />property. He asked if the ability for the properties at 2535 and 2545 Rice Street to access their <br />properties from the south would be impacted if the plan is approved as presented. The Community <br />Development Director replied that the applicant submitted a turning template showing that the median <br />would not impact access from the south to those properties. Mr. Anderson commented that he has <br />concerns with the proposed layout. He stated that the east side of the median would be an 11-foot lane, <br />and he could see that becoming a bottleneck. He asked what would happen if the County did not <br />approve the median. The Community Development Director explained that Rice Street is a county <br />road and therefore the applicant and the County would work together to find the best path forward. <br />Mr. Anderson asked if the Rice Street access is a necessity for the project. The Community <br />Development Director explained that these are the access points being proposed at this time. <br />Mayor Fischer commented that the right-in/right-out proposal was preferable in order to assist in <br />calming the Demont/Rice Street intersection. Mr. Anderson asked if the City would consider making <br />that access only a right -in and not an exit, as the median would then not be required. Mayor Fischer <br />commented that this is the current proposal, with the median. He stated that if the median is not <br />ultimately proposed, the City would still support a right-in/right-out access. The Community <br />Development Director stated that if the County were to deny the plan, City staff would work with the <br />applicant and Ramsey County but ultimately the decision is of Ramsey County. Mr. Anderson asked if <br />there would be notification of the surrounding properties. The Community Development Director was <br />unsure of the notification provided by Ramsey County for that type of action but stated that he could <br />attempt to notify the resident if the plan is not approved by Ramsey County and an alternative is <br />considered. <br />There were no further comments from the public. Upon motion by T. Miller, seconded by Gutierrez, <br />the public hearing was closed. Ayes (5). Nays (0). Motion adopted. <br />Kwapick asked if Flameburger would be impacted by the median. The Community Development <br />Director commented that he did not believe that the access to that parcel would be impacted as the <br />median would be further north and no changes are proposed to that access. Kwapick suggested <br />perhaps if the median, were not approved, they could install a raised wedge in the shared drive access, <br />which would ensure that vehicles leaving the site are only able to turn right. The Community <br />Development Director stated that the applicant is eager to work with the City and County on whatever <br />solution will meet the County standards. <br />0 <br />
