MINUTES <br />City Council <br />May 15, 1981 <br />The foregoing resolution was du7y seconded by Mrs. Nard9ni. <br />Pyes (5) fahey, Nardini, Hanson, Forsberg, Scalze. <br />Mayes (0). <br />Resolution declared adopted. <br />This resolut9on appears in Reso1ution fiook No. 7, Page 747. <br />Mayor Planson reported that the Plann9ng Commission has requested that <br />when the City's zoning maps are updated due to some recent rezonings, <br />that they be g9ven copies of the revised maps. <br />Kath Kath Bros. has requested a side yard and/or front yard set back var9ance <br />6ros. for purposes of constructing an accessory building on their property fior <br />Set Back truck storage. <br />Variance <br />Request Mayor Flanson opened the publ9c hearing that was cal1ed to review this <br />request. <br />7he City Planner submitted to the Council an amendment to the Ci~y's <br />ordinance that would allow a building to be set back at the average of <br />its surrounding bu~ldings. The Planner stated that most cities have <br />such a provision in their ordinance, and it was just an oversite <br />that the City's ordinance does not provide this. <br />The Planner also informed the Council that technica7ly the Ka~h request <br />for a variance does not meet the requirements for a variance. Only the <br />adopt9on of the proposed amendment would allow Kath Bros. to build their <br />building where they are proposing. <br />Councilman Fahey stated that he feels the Council should adont the <br />amendment as there is good use for it in certain settings, and it makes <br />sense in the case of Kath Bros. <br />The Planner stated that the City would have to hold a public he~ring on <br />the proposed amendment before it could be adopCed. <br />Mayor Hanson suggested that the phrase "or S1CIE yard" be added to the <br />first sentence ofi paragraph D of the amendment. <br />Councilman Fahey pointed out that the Kath Rros. property actually fronts <br />on Woocflyn Flvenue. <br />Mr. Nielson stated tha~ Mayor Flanson's suggestion cou1d be added to <br />the amendment prior to the public hearing on the proposed amendment. <br />Nie7son a1so suggested that the City could grant Kath Bros, the variance <br />tonight pending adoption of the ordinance amendment. <br />Fahey suggested that the public hearing be conducted tonight on the variance, <br />but that action be tabled and the Council could then take action on both <br />the Kath request and the amendment at the same time. <br />Mr. Sedlow, a resident of Che area, asked what type of building Kath <br />Bros. was proposing to build. Mr. Kath indicated that it would be a meta1 <br />building similar to the one Kath presently occupies. <br />Paqe -?_- <br />
