MINUTES <br />City Council <br />June 10, 7981 <br />Approv~ng <br />The <br />Vouchers <br />Mr. Hanson introduced the following resolut9on and moved its adoption: <br />RESOLUTION N0. 81-6-?.95 - FlPPROVING THE VOUCHERS <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Pyes (5) Hanson, Fahey, Forsberg, Nardini, Sca1ze. <br />Nayes (0). <br />Resolution declared adopted. <br />7his resolution appears in Resolution Book No. 7, Page 220, <br />Borg The City Attorney reported that Mr. Paul Borg has requested that the <br />Refund Council reconsider refunding the fee Mr. Borg paid for a rezoning <br />Request appl~cation. Mr. Borg contends that the City's present ordinance was <br />not in effect at the time he made app7ication, and therefore the charge <br />he paid also was not in effec~ at that time, <br />7he City Clerk reported that the Council had previously set the fees <br />by Council resolut~on a year before the ordinance was adopted. Therefore, <br />the fees were in effect at the time Mr. Borg made application for a <br />rezoning. <br />Schrier The City Attorney informed the Counci1 that he contacted Mr. Schrier <br />Property regarding entering into an agreement on his pronerty, whereby he ~vou1d <br />pursue sen~or citizen housing for a portion of the property and wou1d not <br />seek a building permit for apartments until he had exhaustecl this possi- <br />bility. Mr. Schrier has informed the Attorney that he does not want to <br />enter into any agreement that will place restrictions on his property. <br />Mr. Schrier commented that the Council knows his feelings regarding <br />what he is interested in developing on his property. Mr. Schrier has <br />requested that the Council take him at his word. Schrier also indicated <br />that he is confident that he will be able to get the senior cit9zen housing <br />development on this property. <br />Mayor Hanson stated that he received a call from Mr. Schrier who indicated <br />that he spoke to Nick Nichols of Plorthland Mortgage. Mr. Nichols indica~ed <br />to Mr. Schrier that there will probably be money available for a senior <br />citizen project. Mr. Schrier also informed Mayor Hanson that he spoke <br />with Johanna Gallagher regard9ng the development and she will contact <br />senior citizens 9n the City to determine if there is still an interest <br />for such housing. <br />Mosted The Attorney informed the Council that Mr. Mosted has had an action served <br />Property agains~ the City. Mr. Mosted is claiming that when Ditch 16 was improved <br />the City widened the dltch and took some of his property without ~aying <br />for it. Mosted is requesting that the City condemn the property so that <br />he can be compensated for it. <br />The Attorney appeared in court on this matter an~ informed the court that <br />Mr. Mosted was compensated for the property taken by the C9ty. The Attorney <br />9nformed the Council that Mr. Mosted has not pursued this matter since 1973 <br />and this act~on will not be effective for this reason. <br />Page -17- <br />
