MINUTES City Council June 10, 7981 Approv~ng The Vouchers Mr. Hanson introduced the following resolut9on and moved its adoption: RESOLUTION N0. 81-6-?.95 - FlPPROVING THE VOUCHERS The foregoing resolution was duly seconded by Mr. Fahey. Pyes (5) Hanson, Fahey, Forsberg, Nardini, Sca1ze. Nayes (0). Resolution declared adopted. 7his resolution appears in Resolution Book No. 7, Page 220, Borg The City Attorney reported that Mr. Paul Borg has requested that the Refund Council reconsider refunding the fee Mr. Borg paid for a rezoning Request appl~cation. Mr. Borg contends that the City's present ordinance was not in effect at the time he made app7ication, and therefore the charge he paid also was not in effec~ at that time, 7he City Clerk reported that the Council had previously set the fees by Council resolut~on a year before the ordinance was adopted. Therefore, the fees were in effect at the time Mr. Borg made application for a rezoning. Schrier The City Attorney informed the Counci1 that he contacted Mr. Schrier Property regarding entering into an agreement on his pronerty, whereby he ~vou1d pursue sen~or citizen housing for a portion of the property and wou1d not seek a building permit for apartments until he had exhaustecl this possi- bility. Mr. Schrier has informed the Attorney that he does not want to enter into any agreement that will place restrictions on his property. Mr. Schrier commented that the Council knows his feelings regarding what he is interested in developing on his property. Mr. Schrier has requested that the Council take him at his word. Schrier also indicated that he is confident that he will be able to get the senior cit9zen housing development on this property. Mayor Hanson stated that he received a call from Mr. Schrier who indicated that he spoke to Nick Nichols of Plorthland Mortgage. Mr. Nichols indica~ed to Mr. Schrier that there will probably be money available for a senior citizen project. Mr. Schrier also informed Mayor Hanson that he spoke with Johanna Gallagher regard9ng the development and she will contact senior citizens 9n the City to determine if there is still an interest for such housing. Mosted The Attorney informed the Council that Mr. Mosted has had an action served Property agains~ the City. Mr. Mosted is claiming that when Ditch 16 was improved the City widened the dltch and took some of his property without ~aying for it. Mosted is requesting that the City condemn the property so that he can be compensated for it. The Attorney appeared in court on this matter an~ informed the court that Mr. Mosted was compensated for the property taken by the C9ty. The Attorney 9nformed the Council that Mr. Mosted has not pursued this matter since 1973 and this act~on will not be effective for this reason. Page -17-
