MINUTES City Council June 10, 1981 However, there is a question of whether or not there has been a trespass by the City, and the judge hearing the action could not determine this. The Attorney reported that a County ditch is described by the center line of the ditch and the judge could not determine what the limit was that the ditch could be said to extend to. Therefore, the judge will set a date for a trial to determine this issue. The Attorney a1so informed the Council that he has submitted the matter to the City's insurance company so that they can take up the defense of the action. Mayor Hanson felt that the Mosted property was improved by the improvement of County ditch #16. The City Attorney also commented that a17 the dirt taken from the ditch was spread on the Mosted property, thus improving the property. Flpprova7 The City Engineer submitted to the Council for approval the plan for Of Plan Park Street. for Park Street Mayor Hanson reported that the Attorney is working on getting tne necessary easements for Park Street. The Attorney reported that he has spoken with Mr. Johnson regarding his easement, and the result of the meeting was that Mr. Johnson will be assessed for Park Street, but the City will pay him enough for his easement to wash out the assessments. Mr. forsberg introduced the following resolution and moved its adoption: RESOCUTION N0. 81-6-296 - APPROVING TNE PLFlNS FOR PARK STREET S B ITTED BY THE CITY ENGINEER The foregoing resolution was duly seconded by Mrs. Nardini. I{yes (5) forsberg, Nardini, Hanson, Scalze, Fahey. Nayes (O). Resolution declared adopted. This resolution appears in Resolution Book No. 7, Page 221. Fiscal Mayor Hanson pointed out to the Council that in their agendas is a Disparities report from Ehlers and Associates, Inc. on fiscal disparities, Poolside Mayor Hanson reported that the fire Marshall will be contacting Poolside regarding the cond~tion of their property. Kellogg Mr. Forsberg reported that the School District would like to renegotiate High School with the City the motion whereby the City dec7ared that the School District Watermain will be assessed for watermain improvement on both Demont and Park Streets Page -18-
