MINUTES <br />City Council <br />June 10, 1981 <br />However, there is a question of whether or not there has been a trespass <br />by the City, and the judge hearing the action could not determine this. <br />The Attorney reported that a County ditch is described by the center line <br />of the ditch and the judge could not determine what the limit was that the <br />ditch could be said to extend to. Therefore, the judge will set a date for a <br />trial to determine this issue. <br />The Attorney a1so informed the Council that he has submitted the matter <br />to the City's insurance company so that they can take up the defense of <br />the action. <br />Mayor Hanson felt that the Mosted property was improved by the improvement <br />of County ditch #16. <br />The City Attorney also commented that a17 the dirt taken from the ditch <br />was spread on the Mosted property, thus improving the property. <br />Flpprova7 The City Engineer submitted to the Council for approval the plan for <br />Of Plan Park Street. <br />for Park <br />Street Mayor Hanson reported that the Attorney is working on getting tne necessary <br />easements for Park Street. <br />The Attorney reported that he has spoken with Mr. Johnson regarding his <br />easement, and the result of the meeting was that Mr. Johnson will be <br />assessed for Park Street, but the City will pay him enough for his <br />easement to wash out the assessments. <br />Mr. forsberg introduced the following resolution and moved its adoption: <br />RESOCUTION N0. 81-6-296 - APPROVING TNE PLFlNS FOR PARK <br />STREET S B ITTED BY THE CITY ENGINEER <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />I{yes (5) forsberg, Nardini, Hanson, Scalze, Fahey. <br />Nayes (O). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 221. <br />Fiscal Mayor Hanson pointed out to the Council that in their agendas is a <br />Disparities report from Ehlers and Associates, Inc. on fiscal disparities, <br />Poolside Mayor Hanson reported that the fire Marshall will be contacting Poolside <br />regarding the cond~tion of their property. <br />Kellogg Mr. Forsberg reported that the School District would like to renegotiate <br />High School with the City the motion whereby the City dec7ared that the School District <br />Watermain will be assessed for watermain improvement on both Demont and Park Streets <br />Page -18- <br />
