MINUTES <br />City Council <br />June 2~, 1981 <br />Mrs. Scalze introduced the follow9ng reso1ution and moved its adoption: <br />RESOLUTION N0. 81-6-312 - INSTRUCTING THE CITY ATTORNEY TO <br />CHECK INT AMENDING THE CITY'S LAND FILL ORDINANCE SO TFIAT <br />IT WILL PROVIDE A TIME LIMIT FOR LAND FILLING COMPLETION <br />AND PROVIDE FOR ANY NECESSARY EXCEPTIONS SO THAT THE CITY <br />WILL BE ABLE TO MAINTAIN CONTROL Of LFlND FTLLING OPERFlTIOMS <br />AND THEIR COMPLETION <br />7he foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) Scalze, Fahey, Hanson, forsberg, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 232. <br />Frattalone Mr. Forsberg expressed concern that Frattalone Excavating was filling <br />F•illing Of lots on Payne Avenue without a fill permit. Forsberg felt that the <br />Lots On filling consisted of more than the 100 yards that is allowed without <br />Payne Avenue a fill perm9t. <br />The City Clerk reported that when the City issues a building permit, <br />this allows the builder to fill the lot so that it is higher than <br />grade. 7his is why the lots on Payne Avenue can be filled without <br />a permit. <br />Mr. Forsberg was concerned as the lots on Payne Avenue are being filled <br />so that they are three to four feet higher than the properties along <br />Edgerton. This is causing drainage problems on the back portion of the <br />properties fronting on Edgerton. <br />The Engineer stated that the developer of Payne Flvenue, Granada Homes, <br />has informed him that they are not filling the rear 20 to 30 feet of <br />the lots on Payne Avenue. BE SENT TO <br />THE DE EL PER f NE AVENUE STATING TNAT ANY FURTHER <br />BUILDING PERMITS OR OCCUPANCY PERMITS u!ILL BF WITNHELD <br />FOR FIOUSES CONSTRUCTED BY THFlT ~EVELOPER UNTIL HE SUBMITS <br />TO THE CITY A BOND TO HFlNDLE THE DRAINAGE OF THE PAYNE <br />AVENUE AREA <br />The foregoing resolution was duly seconded by Mrs. Nardini, <br />qyes (5) Fahey, Nar~ini, Forsberg, Hanson, Scalze. <br />Nayes (0). <br />Reso1ution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 233. <br />Fil7ing Time The City Attorney asked the Council what amount of time limit they had <br />Limit in mind for the completion of a land filling operation. Mayor Nanson <br />suggested that the Flttorney take a look at these types of situations <br />and give the Council an estimate of what he thinks would be a reasonable <br />amount of time. <br />Page -11- <br />
