MINUTES <br />City Council <br />June 24, 1981 <br />Mrs. Nardini reported that one of the requirements of P1r. Sprospy`s <br />mortgage is that he have his house completed by Flugust. <br />Mr. forsberg suggested that the matter be held off on for two weeks <br />due the the recent rain. <br />Mrs. Scalze reported that the neighbors of Mr. Sprospy are not happy <br />with his working on the property during the middle of the night. Mrs. <br />Nardini suggested that if they are not happy with the situation, they <br />should report it to the Sheriff's Department. <br />Mr. Forsberg suggested that the Attorney should inspect the property <br />before the next Counci1 meeting and report to the Council at that time. <br />Mrs. Scalze asked if Mr. Sprospy could alter the edge of the ditch. <br />The Attorney replied that he could as long as he d~d not interfere <br />with the flow of water in the ditch. <br />Mrs. Scalze asked if the City had any easements on the property. The <br />Engineer replied that the City had a 30 foot sewer easement at the back <br />of the property. Scalze stated that development would be prevented on <br />this easement. <br />The Attorney informed the Council that Mr. Sprospy has complied with <br />the requirements in the letter that the Council sent him. However, <br />there may be continuat problems on this property as Mr. Sprospy is <br />continuing to do work on it. Mr. Parks suggested that the City stay <br />on top of the situation. <br />Mrs. Scalze asked if there was anything in the City's ordinance that <br />required someone to finish filling a property by a certain time. <br />The Attorney suggested that such restrictions could be placed on <br />a fill permit. However, a time 1imit could be placed in the City's <br />ordinance. <br />The Attorney suggested that the Council invite Mr. Sprospy to a Counci1 <br />meeting to determine what his intentions are with regard to filling the <br />property. <br />Mrs. Nardini pointed out that a bui1ding permit has a 120 day time 1imit <br />on it. If work is stopped for 120 days, the building permit terminates. <br />Mrs. Scalze suggested that the City Rttorney take a look at the City's <br />ordinance to put a time limit in for filling activities. <br />Mayor Hanson stated that the City needs a code enforcement officer to <br />patrol the City looking for vio1ations of the City code. <br />The Flttorney suggested that the City's ordinance could be amencled to <br />provide a time 1imit, but also to provide for exceptions made in cases <br />where they are needed and to provide for extensions to the time limit <br />subject to Council review. <br />Page -10- <br />
