MINUTES City Council June 24, 1981 The foregoing resolution was duly seconded by Mrs. Scalze. Ayes (5) Fahey, Scalze, hlanson, Forsberg, Nardini. Nayes (0). Resolution declared adopted. This resolution appears in Resolution Book No. 7, Page 23a,. Park The City Attorney reported that he has sent out 15 temporary easements Street for Park Street and 8 permanent and temporary easements. Fle has also Improvement sent out earnest money contracts and prints of the easements needed. The Attorney felt that he should have all the easements within 10 days. Mr. Fahey asked if the Council will be reviewing the amounts of dollars paicl for the easements. The Attorney stated that most of the easements only amount to a few dollars, and the City has already authorized the amount of the Johnson easement. In that case it was agreed to assess Mr. Johnson for the improvement, but pay him an amount for the easement that would wash out the assessment. Mr. Parks also stated that the amount for the Vi11eaux easement wi11 be small, and it was agreed that the assessment would be deferred. Jenny C,osta The Attorney reported that he met with Jenny Costa, Pete Costa and Matter the Costa attorney. Mrs. Costa is asking that the ditch on her property be cleaned out, that the City reimburse her for her attorney's fees, that the City require Mr. Stenger to put a curb around his blacktop to prevent the water from the parking lot and the roof of his building from draining onto her property, and that she be paid additional monies for the ditch easement. Councilman Fahey stated that he felt the problem between Mr. Stenger and Mrs. Costa was a personal one and the City should not become involved. Fahey also stated that he was not in favor of paying additional money for the ciitch easement or for paying for attorney's fees. The Attorney stated that he felt Mrs. Costa had a legitimate complaint about the location of the ditch. The ditch was to be along the property line and there was to be none of the Costa property on the other side of the ditch. The ditch was placed so that it took some of the Costa property. The Attorney stated that if the matter went to court, the City would look bad. The Flttorney also stated that Mrs. Costa has requested that the ditch's bank nearest her house be built up more to prevent water from coming onto her property. The Engineer stated that the ditch was moved to prevent losing a 1ine of trees on the Stenger property. Flfter that decision to move the ditch, the stakes for the ditch were moved again, and this caused the ditch to be in the wrong location on the Costa property. Page -13-
