MINUTES <br />City Council <br />June 24, 1981 <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) Fahey, Scalze, hlanson, Forsberg, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 23a,. <br />Park The City Attorney reported that he has sent out 15 temporary easements <br />Street for Park Street and 8 permanent and temporary easements. Fle has also <br />Improvement sent out earnest money contracts and prints of the easements needed. <br />The Attorney felt that he should have all the easements within 10 days. <br />Mr. Fahey asked if the Council will be reviewing the amounts of dollars <br />paicl for the easements. The Attorney stated that most of the easements <br />only amount to a few dollars, and the City has already authorized the <br />amount of the Johnson easement. In that case it was agreed to assess <br />Mr. Johnson for the improvement, but pay him an amount for the easement <br />that would wash out the assessment. Mr. Parks also stated that the <br />amount for the Vi11eaux easement wi11 be small, and it was agreed that <br />the assessment would be deferred. <br />Jenny C,osta The Attorney reported that he met with Jenny Costa, Pete Costa and <br />Matter the Costa attorney. Mrs. Costa is asking that the ditch on her property <br />be cleaned out, that the City reimburse her for her attorney's fees, <br />that the City require Mr. Stenger to put a curb around his blacktop <br />to prevent the water from the parking lot and the roof of his building <br />from draining onto her property, and that she be paid additional monies <br />for the ditch easement. <br />Councilman Fahey stated that he felt the problem between Mr. Stenger <br />and Mrs. Costa was a personal one and the City should not become <br />involved. Fahey also stated that he was not in favor of paying additional <br />money for the ciitch easement or for paying for attorney's fees. <br />The Attorney stated that he felt Mrs. Costa had a legitimate complaint <br />about the location of the ditch. The ditch was to be along the property <br />line and there was to be none of the Costa property on the other side <br />of the ditch. The ditch was placed so that it took some of the Costa <br />property. The Attorney stated that if the matter went to court, the <br />City would look bad. <br />The Flttorney also stated that Mrs. Costa has requested that the ditch's <br />bank nearest her house be built up more to prevent water from coming <br />onto her property. <br />The Engineer stated that the ditch was moved to prevent losing a 1ine <br />of trees on the Stenger property. Flfter that decision to move the ditch, <br />the stakes for the ditch were moved again, and this caused the ditch to <br />be in the wrong location on the Costa property. <br />Page -13- <br />
