MINUTES <br />City Council <br />June 24, 1987 <br />The City Attorney recommended that the City clean the ditch for Mrs. <br />Costa and that the City offer her up to $300 for the ditch easement. <br />Parks also recommended that the City pay Mrs. Costa $300 as reimbursement <br />for her attorney's fees. The City could end up spending more than this <br />if the case went to court. <br />The Engineer stated that he did not recommen~ raising the bank of the <br />ditch facing the Costa house. This could cost the City a lot of money <br />in landscaping and resoding. <br />Mr. fahey stated that he was not in favor of intervening in the pr9vate <br />matter between Mrs. Costa and Mr. Stenger. <br />Mrs. Nardini introduced the following resolution and moved its adoption: <br />RESOLUTIOM N0. 81-6-315 - ADOPTING THF CITY ATTORNFY's <br />RECOMMENDATIONS FOR THE SOLUTIODI OF THE JENNY COSTA <br />MFlTTER WFIICH ARE AS FOLLOWS: THAT THE CITY CLEAN 7HE <br />DITCH ON THE COSTFl PROPERTY; THFlT MRS. COSTA BE PAID <br />AD ADDITIONFlL $300.00 FOR THE DITCH EASEMENT; FlN~ TFIAT <br />THE CITY PAY $300.00 FOR MRS. COSTA'S ATTORNEY'S FEES; <br />AND THFlT THE CITY REQUIRE MRS. COSTA TO PROVIDF THE <br />CITY WITH A RELEASE OP! TNIS MATTER <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />Ayes (5) fahey, Nardini, Hanson, Forsberg, Scalze. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 235. <br />Spooner P~rs. Scalze informed the Council that she checked on the situation of <br />Park installing a second gate at the lower parking lot in Spooner Park. <br />The reason for the second gate rather than moving the present gate <br />down from the upper parking lot is that that gate is imbedded in <br />concrete and the costs would be high to move the gate. <br />Mr. Fahey stated that he would 7ike to take a look at the lease agreement <br />between the City and the School Board for Spooner Park, fahey was not <br />in favor of 1osing the use of the second parking lot in the Park, <br />This would cause people to have to walk doum to utilize the pavilion <br />in the Park. Fahey felt that the City has cooperated with the School <br />Board over the use of the Park, and that the School Board should <br />cooperate with the City. <br />Mr. Fahey suggested that the City request a meeting with the School <br />Board and have a representative of the Park Commission, and the City`s <br />Recreation Director attend this meeting to discuss Spooner Park. <br />Mr. Fahey fe1t that if the School Board had not wanted the lower <br />parking lot to be used, they would never have allowed it to be put in. <br />Fahey stated that if there is a problem with cars in the park, perhaps <br />there is another so7ution to the problem than blocking off the parking <br />lot. <br />Page -14- <br />
