MINUTES City Council June 24, 1987 The City Attorney recommended that the City clean the ditch for Mrs. Costa and that the City offer her up to $300 for the ditch easement. Parks also recommended that the City pay Mrs. Costa $300 as reimbursement for her attorney's fees. The City could end up spending more than this if the case went to court. The Engineer stated that he did not recommen~ raising the bank of the ditch facing the Costa house. This could cost the City a lot of money in landscaping and resoding. Mr. fahey stated that he was not in favor of intervening in the pr9vate matter between Mrs. Costa and Mr. Stenger. Mrs. Nardini introduced the following resolution and moved its adoption: RESOLUTIOM N0. 81-6-315 - ADOPTING THF CITY ATTORNFY's RECOMMENDATIONS FOR THE SOLUTIODI OF THE JENNY COSTA MFlTTER WFIICH ARE AS FOLLOWS: THAT THE CITY CLEAN 7HE DITCH ON THE COSTFl PROPERTY; THFlT MRS. COSTA BE PAID AD ADDITIONFlL $300.00 FOR THE DITCH EASEMENT; FlN~ TFIAT THE CITY PAY $300.00 FOR MRS. COSTA'S ATTORNEY'S FEES; AND THFlT THE CITY REQUIRE MRS. COSTA TO PROVIDF THE CITY WITH A RELEASE OP! TNIS MATTER The foregoing resolution was duly seconded by Mr. Hanson. Ayes (5) fahey, Nardini, Hanson, Forsberg, Scalze. Nayes (0). Resolution declared adopted. This resolution appears in Resolution Book No. 7, Page 235. Spooner P~rs. Scalze informed the Council that she checked on the situation of Park installing a second gate at the lower parking lot in Spooner Park. The reason for the second gate rather than moving the present gate down from the upper parking lot is that that gate is imbedded in concrete and the costs would be high to move the gate. Mr. Fahey stated that he would 7ike to take a look at the lease agreement between the City and the School Board for Spooner Park, fahey was not in favor of 1osing the use of the second parking lot in the Park, This would cause people to have to walk doum to utilize the pavilion in the Park. Fahey felt that the City has cooperated with the School Board over the use of the Park, and that the School Board should cooperate with the City. Mr. Fahey suggested that the City request a meeting with the School Board and have a representative of the Park Commission, and the City`s Recreation Director attend this meeting to discuss Spooner Park. Mr. Fahey fe1t that if the School Board had not wanted the lower parking lot to be used, they would never have allowed it to be put in. Fahey stated that if there is a problem with cars in the park, perhaps there is another so7ution to the problem than blocking off the parking lot. Page -14-
