MINUTES <br />City Counci7 <br />October 7, 19II1 <br />The City Clerk reported that the interest will be paid at the time the <br />property is transferred, divided, or developed. There will be no <br />immediate charge to the property owner. <br />The City Clerk stated that if the City does not levy this interest <br />between now and 1994 it will cost the City $216,000 in interest. <br />Neuman The City Clerk reported that the Neuman assessment in the amount of <br />Flssessment $1,948.60 has been paid. <br />The C9ty Engineer informed the audience that some of the reasons that <br />assessments were deferred were that a property was considered undividable, or <br />if sewer went in and there was no street assessments were deferred. <br />Petersen The Engineer reported that the Petersen sewer assessment in the amount <br />Assessment of $603.50 and watermain assessment in the amount of $1,026.06 were <br />deferred because the house was located in such a way on the property, <br />that there was not enough property left to divide. Therefore, Petersen <br />was assessed for one normal 1ot and the remaining assessment was deferred. <br />The City Clerk stated that in 1976 the Council passed a resolution rescinding <br />the three year review on this assessment and the assessment would continue <br />to be deferred unti1 the parcel was divided. The City Clerk asked ifi this <br />resolution was binding. The Flttorney stated that he felt the resolution <br />was not binding and that it could be changed. <br />The Engineer commented that if the Petersen house were destroyed, then <br />the property could be divided. The Clerk commented that if St. John's <br />were to sell some property to Mr. Petersen, then the property could be <br />divided. <br />Mrs. Nardini asked what the 135 foot provision was on a corner lot. <br />The Engineer replied that it is the City's policy on a corner lot to <br />assess on the short side of the lot and the first 135 feet on the long <br />side are not assessed, but then the remaining footage on the tong side <br />is assessed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-10-542 - CONTINUING THE DEFERRED ASSESSMENT <br />ON TNE PETERSEN PROPERTY LOCATED AT 2581 McMENEMY FOR SANITARY <br />SEWER IN ThIE FlMOUNT OF $603.50 FlND FOR WATERMAIN IN TNE AMOUNT <br />OF $1,026.06 UNTIL SUCH TIME AS THE PROPERI'Y IS TRANSFERRED OR <br />DIVIDED <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Ayes (5) Fahey, Nardini, Hanson, Scalze, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 359. <br />Page -2- <br />
