MINUTES <br />City Council <br />October 7, 1981 <br />Mr. Fahey stated that the assessments were deferred until the property <br />was sold. Mr. Fahey noted in the minutes of the meeting a~ which <br />this was done that Mr. DeBace commented that all deferrments are reviewed <br />periodically, but it would be noted that these assessments were deferred <br />until the sale of the property. Mr. Fahey commented that the matter of <br />interest was never discussed at the time of the deferrment. <br />One of the property owners commented that at the time of the deferrment, <br />they were informed that the watermain would cost no more than the <br />front footage. Mr. Fahey stated that the interest would not have to be <br />paid unti1 the time the property is sold. This statement was disagreed <br />with by the property owners on Arcade. <br />Mr. Kush commented that he should not have to pay for anything that he <br />does not have on his property. Mr. Kush is one of the property owners <br />that does not have a water stub. <br />The Engineer informed Mr. Kush that he will be getting a water stub. <br />The Engineer informed the Council that in the past watermain and water <br />stubs were assessed separately. Now the cost of the water stub is <br />included in the front footage assessment. <br />Mr. Braham stated that he should not be charged interest as he does <br />not have a water stub, and therefore could not use the watermain even <br />if he wanted to. Braham did not want to be charged interest until <br />the water stub is installed and he could utilize the watermain. <br />Braham commented that currently the watermain is of no value to his <br />property until the water stub is installed. <br />Mr. Forsberg and Mr. Fahey disagreed with the statement that Mr. Braham <br />did not have water. Fahey state~ that the watermain is in the street. <br />Mrs. Braham stated that rf they wanted to hook up to City water they <br />could not as they do not have a water stub. Mrs. Braham commented that <br />interest should not be charged on their assessment until the stub is <br />installed. <br />The Engineer informed the Council that the four water stubs could be <br />installed within a month. <br />Mr. Hazard commented that the people on the east side of Arcade Street <br />are the ones who wanted water, let them pay the interest on the <br />assessments. <br />Mr. Hazard stated that he did not even get a notice of tonight's meeting. <br />The Senty's did not receive a notice. <br />The City Attorney commented that as both the Senty's and Hazard's were <br />present at tonight's meeting, shows that they were aware of the meeting. <br />The City Clerk commented that the City was not 1egally obligated to <br />notify the property owners of tonight's meeting because the assessments <br />have already been levied. <br />Page -23- <br />
