MINUTES <br />City Council <br />October 14, 1981 <br />Kruse The Flttorney reported that there is an error in the Kruse easement and <br />Easement requested that the Council approve a release of easement, and authorize <br />Matter the Attorney to obtain a corrected easement. <br />N1rs. Nardini introduced the following reso1ution and moved its a~option: <br />RESOLUTTON N0. 87-10-613 - AUTHORIZING TFIE CITY FlTTORNEY <br />TO PREPARE A RELEASE FOR TFiE PRESENT KRUSE EASEMENT AND <br />OBTAIM A NEW EASEMENT FOR THE KRUSE PROPERTY <br />The foregoing reso1ution was duly seconded by Mr. Forsberg. <br />Pyes (4) Nardini, forsberg, Flanson, Scalze. <br />Nayes (0). <br />Resolution declared a~opted. <br />This resolution appears in Reso1ution Book No. 7, Pages 398 and 399. <br />4Joodlynn The Attorney informed the Council that he contacted the Soo Line regarding <br />Flvenue a permit for Wood1ynn Avenue crossing. The Attorney will be submitting <br />the necessary information to the railroa.d so that they can process this <br />request and get the permit to the City. <br />Carla Lane The Attorney informed the Council that he sent the 1etter to the person <br />Noisy Party H~ho had the noisy party on Carla Lane. That person called the Attorney <br />and stated that if she did not get an apology from the City she would <br />sue. The person contends that the party she had was a graduation party <br />and was no more noisy than any other graduation party held in the City. <br />She also commented that all of her neighbors were at the party helping <br />to make the noise. <br />Mrs. Nardini informed the Attorney to check with the Sheriff's Department <br />as there was a police call to the party. <br />Mr. Forsberg commented that the Council should not assume someone is <br />guilty just by heresay. The Council shou1d be careful of what they <br />accuse people. <br />The Attorney stated that police calls are not submissible as evidence <br />in court as they do not state what actually happened. A person could have <br />a neighbor who just called the police on them every day and this would <br />show up in police calls. <br />Mrs. Nardini commented that this is not the first time the police were <br />called to this residence. <br />The Flttorney commented that the City could get in trouble if it is not <br />sure of the grouncl it stands on. <br />Mrs. Nardin9 stated that if the Council did not have enough evidence, the <br />Flttorney should have informed the Council of this at the time. Mrs. <br />Nardini stated that she did not receive only one complaint on this party. <br />Mr. Forsberg commented that there are times when the Council must overlook <br />things. <br />Page -19- <br />
