MINUTES <br />City Council <br />October 14, 1981 <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />Ayes (4) Nardin9, Hanson, Sca1ze, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears 9n Resolution Book No. 7, Page 397. <br />Moderate The Planner suggested that he prepare a summary of the information he <br />Rehabilitation recent1y submitted to the Council on the moderate rehabilitation <br />Progr~m program. Mayor Hanson instructed the Planner to do so. <br />Mary House The Flttorney submitted to the Council a purchase agreement for the purchase <br />of the Mary House property. As additional consideration in the purchase <br />of the property besides the $2,500 purchase price, the Flttorney has <br />included provisions for a fence, supervision at the rink, closing time, <br />flood lights, moving e1ectrical box, music, liability insurance, and <br />payment by the City of taxes the ladies have paid on the property for <br />the past six years. The Attorney felt this would not amount to more <br />than $300. <br />Mrs. Scalze commented that it was her feeling that these taxes were to <br />be included as part of the $2,500 purchase price. <br />The Attorney sta.ted that he would submit the purchase agreement to the <br />ladies without the provision of payment of the taxes, and if this was <br />not acceptable, then he would redo the agreement and include this <br />provision. <br />Mr. Morelan expressed concern that the City would not be able to comply <br />with the provision for control of the flood lights. The Attorney <br />commented that the ladies understand that the lights can not be <br />prevented from shining on their property to some extent, but that the <br />City will make a reasonable effort to control this. <br />The Attorney also stated that he will need $500 earnest money for the <br />Mary House, but he wi11 inform the City Clerk when he needs this. <br />Mr. Morelan asked if the Water Department will have to be contacted <br />regarding this purchase. The Attorney stated that the easement will <br />follow the property no matter who owns it. <br />Mr. Forsberg introduced the following resolution and moved its adoption: <br />RESOLU"fION N0. 81-10-612 - AUTHORIZING TFIE CITY FlT70RNEY <br />TO COMPLETE THE PURCNASE AGREEMENT WITH MFlRY NOUSE AS <br />PRESENTED <br />The foregoing resolution was duly seconded by Mr. Hanson. <br />qyes (4) Forsberg, Hanson, Nardini, Scalze. <br />Nayes (0). <br />Resolution declared ~lopted. <br />This resolution appears in Resolution Book No. 7, Pages 397 and 398. <br />Page -18- <br />
