MINUTES <br />City Council <br />Octaber 14, 1981 <br />Mrs. Scalze asked what the City can do with P4r. Gayne for not taking <br />out a bu~lding permit. The Attorney stated that the Council should take <br />him to court for the violation. Mr. Gagne wi71 not only have to pay <br />a double permit fee, but court costs and a fine for the violation. <br />The Attorney also suggested writing <br />City will not be taking any further <br />The Flttorney further suggested that <br />violation of the bui1ding permit. <br />special use question in Mr. Gagne's <br />that the Council pursue this. <br />Mr. DeBace a letter stating that the <br />action on the conditional use permit. <br />Mr. Gagne shou7d be prosecuted for <br />ihe Flttorney also stated that the <br />case is a different matter and suggested <br />Mrs. Scalze did not agree that the special use permit was different in the <br />Gagne and DeBace cases. <br />The Planner pointed out that Mr. Gagne is in violation for building on <br />a proposed future street. It was a condition of his rezoning that he <br />not build in this area. <br />The Attorney suggested that he could be charged with building in an <br />unauthorized location. Mrs. Nardini asked if Mr. Gagne could be made to <br />move the building. The Attorney stated that the City could demand this. <br />Mrs. Nardini asked if the fine Mr. Gagne would be charged would cover the <br />City's legal fees. <br />Mrs. Nardini stated that unless the City makes P~r. Gagne move the building, <br />there is no purpose in pursuing it. <br />Mr. Forsberg stated that he w~s not in favor of backing off on this. <br />The Attorney stated that the City did stand a chance of making Gagne move <br />the building. Mrs. Nardini felt that the City should pursue the matter <br />with this intention. <br />Mr. Forsberg asked how the City can enforce these things. The project <br />was red-tagged, but Mr. Gagne just kept building. <br />D1rs. Scalze stated that Mr. DeBace should be sent a letter informing <br />him that the City will not pursue this matter any further. Mr. Gagne <br />should be requested to take out a building permit and in the meant9me <br />the Flttorney will research the matter further with regard to the <br />requ~irements placed on the property at the time of rezoning. <br />The Attorney also stated that he would prepare an amendment to the <br />ordinance that will clarify the ordinance with regard to these situations. <br />The Planner stated that this amendment should be reviewed by the P1anning <br />Commission before it goes to the Council. <br />Deferred The City Clerk reported that the law has been changed permiting persons <br />Assessments who are retire~ and under age 65 or disabled to get assessment deferrments. <br />For The <br />Retired Mr. Flanson commented that on Edgerton Street there are many senior citizens. <br /> This could effect the proposed improvernent on Edgerton as many of the <br /> asse ssments could be deferred. <br /> Page -21- <br />
