MINUTES <br />City Council <br />October 28, 1981 <br />The Attorney commented that the City could control what a person stored <br />outdoors that was a nuisance. But the Flttorney did not feel that any <br />community could attempt to control what someone might store in his garage. <br />Mrs. Goodlake commented that she believed Mr. Gear did not have an office <br />and operated his business from his home. The P1anner commented that <br />certain types of home occupat9ons are allowed and others require a permit. <br />The Planner commented that the ordinance says the accessory buil~ing is <br />accessory to the main use of the lot. The Planner did not feel that <br />storage of apartment equipment was intended to be permitted. <br />Without this provision in the ordinance, the Planner felt that the <br />City cou1d get in the position where the garage could be rented out. <br />Mrs. Scalze expresse~ concern that the Planner gives the Counci1 one <br />opinion and the City Attorney g~ves another. <br />Mrs. Nardini commented that she personally felt it was an advantage to <br />approve the garage so that some of Mr. Gear's equipment could be stored <br />inside. Mrs. ~lardini fe1t the neighbors would appreciate some of these <br />things being enclosed. <br />Mr. Forsberg stated that the Council should handle the situation of Mr. <br />Gear's running a business from the garage if this ever came up. Forsberg <br />felt that if it was not bothering the neighbors, the Council should not <br />be involved. <br />Mr. Goodlake questioned the ability of someone to prove that a property <br />owner was running a business from him home. <br />Mr. Forsberg agreed it would be difficult unless there were some ex~reme <br />situations going on. <br />The City Attorney commented that a lot of people are storing things, <br />perhaps even for relatives. The Flttorney commented that peop1e wi11 <br />not stand for being as strictly governed as to what they can store in <br />their garages. The Flttorney commented that 95% of the people would be <br />in violation of the law. <br />Mr. Goodlake stated that as soon as this garage went up his property <br />value would go down. <br />Mr. Gear stated that Mr. Goodlake also owned apartments and has stored <br />appliances in his garage. <br />Mr. Forsberg introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-10-633 - CLOSING THE Pl1aLIC HEFlRING <br />ON TfiE CONDITIONP,L USE PERMIT REQUEST FOR AN FlDDITIO~IAL <br />GARAGE MADE BY MR. b1ILLIAM GEAR <br />The foregoing reso1ution was duly seconded by Mrs. Nardini. <br />qyes (5) Forsberg, Nardini, Hanson, Fahey, Scalze. <br />Nayes (0).
