MINUTES <br />City Council <br />October 28, 1981 <br />Mrs. Scalze stated that she spoke with Mike Gallagher of the Flttorney <br />General's office and was informed that they would not give out an <br />opinion on this matter without an indepth study. <br />Mrs. Freeman commented that the Flttorney Genera7's office led her to <br />believe that she was grandfathered in. <br />Mr. Fahey stated that it was not illegal for the Council to change the <br />City's vacation policy. Mr. Fahey asked the Council if they wanted to <br />leave the vacation po1icy where it is. <br />Mrs. Scalze stated that she Hias not in favor of voting any more on this <br />subject. <br />City Mr. Fahey informed the Council that he has spoken with the City Attorney <br />Attorney an~ would like to present his dissatisfaction w~th the work Mr. Parks <br />has done as City Flttorney. Fahey commented that he would like to solicit <br />applications for the City Attorney position in 19E2. Fahey felt that in <br />a lot of cases the job was not getting done. Some of the instances that <br />were cited by Mr. Fahey are that the Attorney's opinions at meetings are <br />inaccurate, the Jenny Costa easement, the trapping ordinance, the Hamel <br />goat situation, St. Jude's PUD Agreement, the City vacation po1icy, <br />the conditional use permit situation, the park charge ordinance> travel <br />time for recreation personne1. Mr. Fahey felt that the Flttorney does not <br />read the Council meeting minutes and does not follow up on things that <br />he has been instructed to take care of. Fahey stated that he can no <br />longer support Mr. Parks as City Attorney. Fahey commented that the City <br />needs sound legal advise. <br />Bev Jespersen appeared before the Counci1 and stated that she is hearing <br />a lot of things that the City Attorney has not done. Mrs. Jespersen <br />suggested that the Council look at the Flttorney's vouchers and see all <br />the things that he has done for the City. <br />Mr. Fahey stated that he would agree if he were only tall<ing about one <br />occasion. <br />Mr. DeBace appeared before the Council. Mr. DeBace stated that because <br />the City Attorney's opinions did not agree with Mr. fahey's opin9ons, <br />Mr. Fahey does not like them. Mr. DeBace suggested that Mr. Fahey do <br />some research into some of the things he is talking about, such as the <br />Jenny Costa easement. Mr. Fahey stated that he has researched these <br />matters. Mr. DeBace stated that the Council should know what it is <br />talking about before the matter is spread all over the City. <br />Mr. DeBace commented that the City Attorney knows city law and has been <br />working with such things for years. <br />P~r.
