r•~zNUrEs
City Council
October 28, 1981
Mr. Fahey stated that as an attorney himself, he believes he has a
better basis than most of the Council to judge this situation.
Fahey also commented on the Mary House situation and the question
that was raised by Mr. Forsberg on the easement the Water Works had
on the property. Fahey stated that he spent about half a day in court house
on this matter and told the Gity Attorney where to find the information.
Mr. Fahey also commented on Mrs. Nardini's asking the Flttorney if he
has completed this or that, and the Attorney is not following up on
these things. Fahey stated thet in a City of this size this should not
continue to happen.
Mr. DeBace stated that the legal work shou1d be teft to the City Attorney.
Mr. DeBace commented that Mr. Fahey is getting his job mixed up with that
of the Attorney's. Mr. De6ace stated that he has taken the Attorney to
task when he was on the Council, but at the same time he wanted to be as
fair as possible.
Mr. Morris Jespersen appeared before the Council. Mr. Jespersen commented
that since Mr. Parks has been City Attorney, the City has installed a
complete sewer system and the Attorney has to obtain all the easements
for this.
Mr. Fahey commented that he had to obt~in the easement for Bob and Linda
Johnson himself.
Mr. Jespersen commented that perhaps the Council should be looking at the
job some of the other people are doing for the City. Mr. Fahey commented
that he had no problem with the job the P1anner or Engineer are doing
for the City.
Mr. Jespersen commented that the City will loose all its people and the
Council will end up starting a11 over again with new people.
Mr. Fahey commented that meeting after meeting the Council is finding
things that are not done.
Mr. Parks commented that there are a lot of things he does for the City
and certain things that he feels are more important are done first.
Mr. Parks commented that he would not defend himself as it seemed to be
a cut and dried situation.
Mr. Forsberg commented that it is not cut and dried.
Mr. Parks stated that in the eleven years he has been City Attorney he
has obtained a lot of easements for the City and the City has only had
to condemn one piece of property in order to obtain an easement.
Mr. Parks stated that he has worked weekends and nights for the City.
Mr. Parks also stated that he could not live on the income he obtains
from his position as City Attorney and has other interests he also
pursues. Mr. Parks stated that when the Council asks him to do something,
he will do his best to get the job done, but there are times when he is
doing other things. The Attorney stated that sometimes even working full-
time for the City it is not possible to get things done for the next meeting.
Page -28-
