MINUTES <br />City Council <br />October 28, 1981 <br />The Foregoing resolution was duly seconded by Mrs. <br />qyes (5) Fahey, Scalze, Hanson, Forsberg, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This reso1ution appears in Resolution Book No. 7, <br />Scalze. <br />Page 409. <br />Conditional Mr. Perry Shortage and Mr. Leroy LaMay appeared before the Council <br />Use requesting approval of a conditional use permit for a duplex in an R-1 <br />Permit area. <br />Request For <br />Duplex Mr. Fahey commented that he would like to see as part of the approval <br />Perry of the permit that the garage is brought within setbacks. Mr. LaMay <br />Shortage replied that this has been done. <br />The Planner commented that the request meets the requirements of a <br />conditional use permit. hiowever, the plan calls for two driveways, <br />and this is not allowed in the ordinance for the size lot in question. <br />Mrs. Nardini commented that in justifiication of the City's fee, this <br />plan is supposecl to go to the Planner and the Planner has not seen it. <br />Mr. Fahey stated that when the City approves a duplex in an R-1 area <br />it should be on the basis of the Council's approval of the plans. <br />Mayor Hanson stated that as individuals the Council may or may not <br />like the appearance of the duplex, but the Council should not base <br />approval on this. <br />The Planner stated that the two driveways would require a variance <br />from the Council. <br />Mr. Fahey stated that he has no opposition to the auplex, but it should <br />comply with City Code. <br />Mr. Shortage commented that he brought this plan in to the City a couple <br />of weeks ago so that it could be reviewed and there would be no problems <br />at tonight's meeting. <br />Mrs. Sca1ze asked if the plans were in in time for the Planning <br />Commission meetin~. Mr. Shortage replied that they were not. <br />Mr. Fahey asked when construction was anticipated to begin. Mr. Shortage <br />replied tomorrow. <br />Playor Hanson commented that Mr. Shortage should have found out about the <br />double driveway before this. Mr. forsberg agreed. <br />Mr. Fahey commented that in effect the house was a zero lot line home. <br />Fahey commented that Mr. Shortage should be aware that the City would <br />not approve a property div~sion of this home in the future to allow <br />two private residences with zero lot lines. This would not meet current <br />C~ity ordinances. <br />Page -6- <br />
