~~iNUrLs <br />City Council <br />January 6~ 1982 <br />Mr. I'a.hey pointed out that resolutions would not be covered by the retainer. <br />Mr. Sweeney stated that this is correct and commen'ted that his firm could <br />provide forms for the City sta£f to write any resolutions. <br />Mr, Fahey asked if the Council had l~ir. Sweeney review resolutions £or <br />bond sales if this would be covered by the retainer. Mr, Sweeney stated <br />tlaat this would be correct, however~ the bond counsels usually prepare <br />these resolutions, If Mr. Sweeney were to draft the resolutions, this <br />would not be covered under the retainer. <br />Fahey asked Mr, Sweeney if he would Plnd it difi'icult or uncomfortable to <br />represent the City knowing there was another Attorney on the Council, <br />Mr. Sweeney stated that he would have no problem with this. Mr, Sweeney <br />stated that he would tell the Council what the law is and give his opinion <br />as to how Ceunci~, actions relate to the law. <br />Mr. Fahey in£ormed Mr. Sweeney that he feels the City is not getting <br />adeguately researched opinions and varying opinions from meeting to <br />meeting. <br />Mr. Sweeney stated that he feels the quicker he can give an opinion the <br />better. SWeeney stated that if he knows the answer to a question, he <br />will give an answer, However~ if he does not have all the facts~ he would <br />iake the time to look at it and come back with an opinion, Sweeney stated <br />that he has asked other cities to purchase a set of State Statutes, <br />Mr. Sweeney also stated that he would be reviewing agendas be£ore the <br />meetings to prepare himself to be able to act at a meeting, <br />Mr. Hanson asked Mr, Sweeney his exper~ence with City Planners. Sweeney <br />stated that his experiences have been varied. Mr, Hanson asked Mr, Sweeney <br />if he £elt ordinances slvotil.d be drafted by planners or legal professionals. <br />Sweeney stated that a draft can be done by a planner. However, planners <br />tend to practice law and sometimes do not have enough experience with <br />enforcement, Mr, Sweeney stated that his experience has been good once <br />it is established who the planner is and who the lawyer is. <br />Mr. Sweeney stated that his representing the City of Blaine would not <br />interfer i£ he were to also represent Little Canada. Sweeney stated that <br />he has a lot of subspecialists in his office and would have an extremely <br />short turn-around time £or getting work done. <br />Mr. Aanson asked if Mr, Sweeney had experience in obtaining easements. <br />Sweeney replied that he did. Mr. ~weeney stated that it is sometimes <br />difficul.t to get someone to agree to a price £or their property and <br />negotiations can be a time consuming process. Sweeney stated that through <br />condemnation there is a set timing developed. Mr, Sweeney stated that if <br />the City is under the gun to get a project started it could begin condQ~a.tion <br />proceedings and then continue negotiations during the process. <br />Mrs. Nardini asked which process were most expensive. Mr, Sweeney replied <br />that condemnation was the most expensive. <br />Mr. Forsberg stated that he would not be in £avor of condemning property. <br />Forsberg stated that Little Canada is a small city and the Counci7, knows <br />its residents, Forsberg commented that he would like to think the Council <br />did things on a fair basis. <br />Page -2.. <br />
