~IINUTES <br />City Counci:L <br />January 13~ 1982 <br />Gagne i~ir.Fahey can~nented that he would like to hold a closed-door session <br />ilatter on the Gagne matter following the Council rneeting. Fahey also stated <br />that he was not in favor of a private session with Mr. Gagne, <br />Mr. Forsberg stated that he was willing to meet privately with Mr. Gagne, <br />Fahey stated that he felt the Council shoul.d discuss the case with the <br />new City Attorney and bring him up-to~date, k'ahey stated that Mr, Gagne <br />is present at the meeting and should address the Council at this time <br />if he wishes. <br />rLr. Gagne stated that he just came down to the meeting because it was <br />an open meeting and if the Council wished to address his case~ that <br />was O.R, with him, <br />Nir. Fahey stated that he feJ.t it was a violation of the open-meeting <br />law to meet privately with a citizen. <br />Nir. Forsberg commented that the letter the Couxicil received states that <br />the Council will rneet with Mr. Uagne. <br />Mrs. Nardini stated that the City Attorney is brand new to the City and <br />should be up-dated on the matter, <br />Forsberg commented that the Council should take steps to settle this <br />situation and the court said that the City should work with Mr. Uagne <br />on this. <br />St was suggested that the Counoil recess for £ive minutes so that the <br />new City Attorney could review the letter the City received. <br />The meeting was recessed at 9;15 Y,M. <br />The meeting was reconvened at 9:25 P.M. <br />Council then anformed the members of the audience that the Council will <br />now hold a private session with the new City At.torney to up-date him <br />on the case. Council will reconvene £ol:lowing this up-date. <br />'Phe meeting was again reconvened at 10:00 Y.M. <br />Nlayor Hanson informed Mr. Gagne that the City Attorney will address the <br />issue. <br />Mr. Sweeney~ City Attorney~ informed Mr. Gagne that he reviewed the Letter <br />of January 11, 1982 which is a status report S'rom Clayton Yarks~ o£fice. <br />That letter indicates that Judge FLeming expressed the opinion that the <br />City should indicate its position as to this case, <br />Mr. Sweeney informed Mr. Gagne that in the private session that was just <br />held the Council determined its position to be that 24r. Gagne should <br />first obtain a bui.Lding permit ana pay a double fee for that permit <br />since it was obtained after construction of a 21~ £oot by 26 foot structure. <br />5econdly~ Mr. Gagne shou].d apply for a conditional use permit with an <br />additional stipulation that in the permit it state at such time as the <br />street (Condit) would be extended on the west side o£ the property or <br />the road be dedicated or established as a right-of-way, the property <br />Page -15- <br />
