~IINUTES City Counci:L January 13~ 1982 Gagne i~ir.Fahey can~nented that he would like to hold a closed-door session ilatter on the Gagne matter following the Council rneeting. Fahey also stated that he was not in favor of a private session with Mr. Gagne, Mr. Forsberg stated that he was willing to meet privately with Mr. Gagne, Fahey stated that he felt the Council shoul.d discuss the case with the new City Attorney and bring him up-to~date, k'ahey stated that Mr, Gagne is present at the meeting and should address the Council at this time if he wishes. rLr. Gagne stated that he just came down to the meeting because it was an open meeting and if the Council wished to address his case~ that was O.R, with him, Nir. Fahey stated that he feJ.t it was a violation of the open-meeting law to meet privately with a citizen. Nir. Forsberg commented that the letter the Couxicil received states that the Council will rneet with Mr. Uagne. Mrs. Nardini stated that the City Attorney is brand new to the City and should be up-dated on the matter, Forsberg commented that the Council should take steps to settle this situation and the court said that the City should work with Mr. Uagne on this. St was suggested that the Counoil recess for £ive minutes so that the new City Attorney could review the letter the City received. The meeting was recessed at 9;15 Y,M. The meeting was reconvened at 9:25 P.M. Council then anformed the members of the audience that the Council will now hold a private session with the new City At.torney to up-date him on the case. Council will reconvene £ol:lowing this up-date. 'Phe meeting was again reconvened at 10:00 Y.M. Nlayor Hanson informed Mr. Gagne that the City Attorney will address the issue. Mr. Sweeney~ City Attorney~ informed Mr. Gagne that he reviewed the Letter of January 11, 1982 which is a status report S'rom Clayton Yarks~ o£fice. That letter indicates that Judge FLeming expressed the opinion that the City should indicate its position as to this case, Mr. Sweeney informed Mr. Gagne that in the private session that was just held the Council determined its position to be that 24r. Gagne should first obtain a bui.Lding permit ana pay a double fee for that permit since it was obtained after construction of a 21~ £oot by 26 foot structure. 5econdly~ Mr. Gagne shou].d apply for a conditional use permit with an additional stipulation that in the permit it state at such time as the street (Condit) would be extended on the west side o£ the property or the road be dedicated or established as a right-of-way, the property Page -15-
