This sti~ulation would be filed in the property~s abstract. <br />Mr. Forsberg pointed out to P4r. Gagne that this may never happen. <br />Mr. Uagne expressed concern that the Counc:il. just had a hal£ hour to <br />discuss its position with two attorneys and he was being put on the spot <br />to discuss the case without benefit of legal counsel. Gagne stated <br />that the Council has gone against the idea of what the Judge was trying <br />to accomplish. <br />Mrs. Nardini commented that the City has a new Attorney and the Council <br />was trying to fill hi.m in on the case. <br />Fahey informed Mr. Gagne that the Council is bound to en£orce the City~s <br />ordinances. <br />Gagne stated that the City will not give him a building permit after he <br />applied for oxie. Gagne also suggested that the Council look at the <br />requirements in the ordinance under an H-1 zoning district and that the <br />Council read the letter that was sent to him by the Building Snspector. <br />Mr. Uagne then le£t the meet9ng. <br />NIx~, Forsberg commented that he could not nnderstand why this situation <br />could not be worked out and that the Council should sit down with Gagne <br />and talk it over. Mr. Forsberg stated that the Council has done <br />everything it can do and that the courts should handle it, Forsberg <br />also stated that he did not agree with Mr. Gagne~s statement about <br />the Council having two attorsieys to discuss the mmtter with as Mr. Fahey <br />serves on the Council in the capacity of a Councilperson. <br />Mrs. Nardini suggested that Mr. Sweeney take over the Gagne litigation. <br />Mrs. Nardini introduced the following resolution and moved its adoption: <br />R:F:SOLUTION N0. 82-1-33 - ASStiiNING THE GAGNE CASE TO THE <br />FI OF SWEENEY~ O~CONNOIi AND LAMAY <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) I~ardin~9 Fahey~ Forsberg, Hanson,Scalze. <br />lvayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 8~ Page l~, <br />Si.gn Ylan Mrs. Nardini informed the Council that the Building Inspector feels the <br />Check Fee $100 plan check fee for signs is excessive. Nardini stated that the <br />Planner will no longer handle this and the Building Inspector will. <br />Nardini suggested that the Cowncil consider this, <br />Workshop Mr, Ha~son asked the Council~s feel~~?gs_on holding some workshop sessions <br />Session with the Planning Commission to review the City~s Zoning Ordinance. <br />With ~. Fahey suggested that the Council wait a couple of months on this <br />Ylannyng to let the new Building Inspector become familiar with the City~s <br />ordinances. <br />Page -16- <br />
