MINUTES <br />City Council <br />May 7_6, 1982 <br />Payne Avenue Mrs. Scalze stated that Che swail is Granada i{omes's responsibili.ty <br />Drainage and if i.t is out of the easement, they would be the ones to move ite <br />(Conte) <br />Attorney The Attorney submitted to the Council for their in£ormation repor.ts <br />Reports on the Collova and Mosted matters. <br />Agenda The Attorney submitted to the Counci.l a dra£t of an agreement <br />Item Dlo. ?_2 between the City and Ar.t Ryan. The Attorney asked that the Council <br />determine that the ap,r.eement covers a11 the poi.nts that were <br />previ.ously discussed. <br />Mr. Hanson commented that until the contractor £inishes the work he <br />is to do Mr. Ryan cannot begin his portion of the wortc. The Ci.ty <br />has requested that Mr.. Ryan complete his portion by Sep'embe~ 1. <br />The F,ngineer staCed that the contractor will start by June 21. <br />Mr. Forsberg stated that if Mr. Ryan signs the agreement and then <br />needs an extension for the completion of the ~oorlc, Mr. Forsberg <br />had no problem with the extension being granted. <br />Mr. Hanson stated that he believes that Mr. Ryan will be coming in <br />to the Council requesting a buil.ding permit. Hanson again pointed <br />out that Mr. Ryan cannot complete his portion of the work unti.l the <br />contractor does. <br />Mr. Forsberg stated that he was not in favor of approving anything <br />for Mr. Ryan until Mr. Ryan completes the work. hlr. rahey stated <br />that he apreed ~oith this. <br />Mr. Hanson asked if the Council had the right to deny a building <br />permit if Mr. Ryan si.gns the agreement. The Ci.ty Attorney stated <br />that if Mr. Ryan si.gns the agreement, the Council between now and <br />September 1 does not have the right to deny a permit. <br />Mrs. Nardini asked if the worlc was not done by September 1 if. the City <br />could do the ~aork and assess the cost back. The Attorney stated that <br />the City does not have the money to do the toark wi~h ouC a public <br />improvement being ordered. <br />Mr.s. Scalze poi.nted out thatat previ.ous Council meeting the Council <br />informed Mr> Ryan that if he signed the agreement~ the Council woulcl <br />consider transEer.ri.ng a.tuilding permi.t that Mr. Ryan already has <br />talcen out. <br />The City Attorney po:inted out that [he Council needs a wa:iver of <br />rights f.rom Mr. Stenke and Peterson Mai.ntenance that they wi11 not <br />appeal their assessment. Fahey stated that if the Council does not <br />get these waivers, the Council should put a11 the assessments on <br />Mr. Ryan~s,two lots. P4r.
