MINUTES <br />City Council <br />May 26, 1982 <br />Ordinance The foregoing ordinance was duly seconded by Mrs. Scaize. <br />IDo. 186 (Cont.) Ayes (5) Nardini, Scalze, Fahey, Forsberg, Hanson. <br />Nayes (0). <br />Ordinance declared adopted. <br />Yayne Avenue P1r. Fr.~tsoerg asked the Clerk if he sent a letter to Mr. Garske as <br />Urainage requested at the Last Council meeti.ng. The CLerk replied that he <br />Easement did not as he understood that no action was going to be taken. <br />Vacation <br />~ Mr. Por.sberg reported that Mr. Garske has removed his portion of <br />Agenda the swail. Mrs. Scalze aslced if the City has an easement, if the <br />Item No. Zl City can put the swail back in. Scalze also asked who's drainage <br />Mr. Garske is bLocking. Mr. Forsberg repLied that he is bloclcing <br />his own drainage. <br />The Engineer stated that he thought the Council decided that it wasn't <br />hurting anything the way it is. The Engineer suggested tha[ the Council <br />not issue a permit on the other two of Garske's lots unCi1 the swail <br />is put back in. <br />It was reported that the CiCy must hold a public hearing to consider <br />the vacation of the Robert Jackson easement on Payne Avenue. <br />Mrs. Scalze introduced the Lollowing resoluti.on and moved its adootion: <br />RESOLUTION N0. 82-5-300 - CALLING POR A PUBLZC <br />IIEARING TO CONSIDER THE VACATION OT' PAYNT f~VENiJE <br />DRAINAGE EASEMENTS, THE HEARING TO IIE I{ELD <br />ON JUHE 23, 1982 <br />'Che foregoing resolution was duly seconded by ~(r. i~1an"son. <br />Ayes (5) Scalze, Ilanson, ror.sberg, Fahey, Nardin:i< <br />Nayes (0~). <br />Resolution declared adopted. <br />This resoLution appears i.n Resolution I3ooic No. 8, Page 252. <br />Mrs. Scalze reported that Mr. Lunders on Payne Avenue feels that the <br />drainage swail i.s out ot the easement on his property. Mrs. Scalze <br />felt that the City should be withholding building permits until <br />this si.tuation i.s talcen care of. <br />Mr< Forsberg, and the En~;i.neer stated that they thought the Council <br />agreed nor. to do anything about thi.s situation. Mrs. Scalze suggested <br />that perhaps she should have Mr. Lunders come into a Council meeting <br />to better explai.n the situat:ion. <br />Mr. Porsberg suggested that the Enpineer and he would ~o and tal<e a <br />loolc at the Lunders' swail. <br />Page -24- <br />
