Hanson also stated that Che <br />taxes Mr. Kroiss i.s paying on hi.s property are probably considerable. <br />Mr. Laclcner stated that he feLt the situation made a di.f.fer.ence when <br />there was an exisCin~ build~ing on a piece of property. <br />Mr. iCroiss stated thaC he bou~;ht the I3ronson property. Kroiss stated that he did noC feel his plat should <br />be turned down just because the people i.n the area ~oanC the vi.ew. <br />Mr. Hanson aslced the Ci.ty Attorney i_E Mr. Kroiss met the City's Codes <br />on tiohat: Uasis the City could turn down his proposal. <br />The Ci.ty 9tCOrney replied that the courts have not dealt with a lot of <br />platti.np, cases. The purpose of the Codes is to set up regulations <br />f.or the City's health, safety and welfare. The Attorney stated that <br />if. tlie subdi.vi.sion complies with al.l aspects of the Cit:y's Code, the <br />Council co~il.d sti.ll. refuse Co approve the plat. Ho~aever, the courts <br />wouLd Loolc at Che City's reasons for re£usal. There must be good <br />reasons f.or refusal. <br />The Ci.ty ksngi.neer inc(icated that there i.s sewer ava:ilable f.or a11 the <br />loCS, but Mr. Kroiss would have to put i.n his own pump:i.np, station <br />f:or at least two of the 1ots. <br />Mr. Kroiss explai.ned to the Counci.l how he would construcc a house <br />on the proposed Lot l. On Lot 7_ there would be no problem with <br />construction and on I.,ot 3 there is an existing home. Lot 4 Che <br />home woulcl be constructed about 170 f.eet fr.om the road. <br />Mrs. Scalze indica[ed that ~e caould not be i.n favor of: a var:iance. <br />Page -3- <br />
