The City Attorney replied that it would not. <br />Condi.tional Use The Attorney commented that this was of no va].ue on the f.i.li.ng <br />Permits [orm and asl<ed if the Council wanted this out ;.n rhe ordi.nance. <br />Agenda Mr. i'ahey aslced i£ the c:ity had anything i.n the ordi.nance that says <br />Item No. 6 a violati.on o[ the zoning ordinance is a criminal. misdemeanor. The <br />Attorney replied that the City had this, but it di.d not apply to <br />a vari.ance, <br />Pahey aslced i.f the C~.ity shoulci put this in the ordi_nance, or leave <br />it out and revoke a variance if necessary. <br />The Attorney stated that a variance could be revolced if. someone went <br />beyond the vari.ance. 'The City would have to ~o to court in this <br />i.nstance. <br />The Attorney r.eported that the Itamsey Count_y Recorder has not yet <br />addressed the S.ssue of unif.orm filinp, forms. The At[orney scated <br />Chat the f.orms before the Counci.l are the recommendation of the <br />Ci.ty Planner. The Attorney sug~ested that he verify with the Recorder's <br />Of.f.ice that these forms would be acceptable to them. <br />Mr. Pahey suggested that before the Attorney verify the forms, the <br />Council stri.lce paragraph 5 f.rom the forms. <br />Mrs. Scalze aslced the City Clerk if the term Special Use Permi.t has <br />been eliminated, The Ci.[y Clerk stated that thi.s was correct. <br />Scalze commented that then everything was cal.led a condi.Ci.onal use <br />per.mit.
