<br />MINERAL RIGHTS
<br />All minerals, mineral rights, royalties, oil and gas rights and profits arising from or accruing to the
<br />Project and all amounts payable to the surface rights owner by any owner of the mineral or other
<br />substance rights.

<br />WASTE DISPOSAL AND SEWER FACILITIES
<br />All waste disposal of the water, sanitary and storm sewer systems and septic systems and all
<br />components thereof now or hereafter owned by the Borrower which are now or hereafter located
<br />by, over, and/or upon the Property or any part and parcel thereof, and which water system includes
<br />all water mains, service laterals, hydrants, valves and appurtenances, and which sewer system
<br />includes all collection tanks, service laterals, hydrants, valves, sanitary sewer lines, including
<br />mains, laterals, manholes and appurtenances.

<br />UTILITY LINES
<br />All private rights to access or use public utility lines of any type or nature, including wires, pipes,
<br />conduits, cables, fiber optics, and ducts for utility systems used for domestic cold and hot water,
<br />sanitary sewer, storm sewer, chilled water, condenser water, heating hot water, steam, steam
<br />condensate, natural gas, control compressed air, conditioned and non-conditioned air, ventilation
<br />and exhaust air, electricity, security, fire alarm, emergency communications, systems control and
<br />automation, video monitoring, telephone, television, other telecommunications systems, and other
<br />mechanical, electrical, and related life safety systems.
<br />II.
<br />WATER SUPPLY FACILITIES
<br />All of Borrower’s interest in all mains, service laterals, storage tanks, piping, valves,
<br />manholes, wells and appurtenances for the furnishing, transmission, storage and disposal of
<br />potable water to the Project.
<br />The above shall also include all proceeds, products, accessions, additions and supporting
<br />obligations thereto. It is specifically understood that the enumeration of any specific articles of
<br />property shall in nowise exclude or be held to exclude any items of property not specifically
<br />mentioned. All of the Premises hereinabove described, real, personal and mixed, whether affixed
<br />or annexed or not, and all rights hereby conveyed and mortgaged are intended to be as a unit and
<br />are hereby understood and agreed and declared to be appropriated to the use of the Premises and
<br />shall for the purposes of this Security Instrument be deemed to be real estate and conveyed and
<br />mortgaged hereby.
