Little Canada City Code 827-3 827.020 Initial Zoning Compliance Check. A. Zoning Verification. Pursuant to Minn. Stat. 342, within 30 days of receiving a copy of a state license application from OCM, the City of Little Canada shall certify on a form provided by OCM whether a proposed cannabis business complies with local zoning ordinances and, if applicable, whether the proposed business complies with the state fire code and building code B. Registration. Successful approval of a site for zoning compliance does not guarantee approval of local registration for retail locations. A complete application for retail registration must still be applied for and obtained by a retail business before operations can begin. 827.030 Consent to Registering of Retail Cannabis Businesses. A. Registration Required. No individual or entity may operate a state-licensed cannabis retail business within the City of Little Canada without first registering locally with the City of Little Canada B. Non-Registered Sales Civil Penalty. Any state-licensed cannabis retail business that sells to a customer or patient without a valid local retail registration shall incur a civil penalty of (up to $2,000) for each violation. 827.040 Limiting of Retail Registrations. The City will not issue more than one (1) cannabis retail registration per 12,500 residents, as determined by the most recent state demographer’s estimate. This cap on registrations does not apply to a medical cannabis combination business with a retail endorsement or a lower-potency hemp edible retailer. 827.050 Minimum Buffer Requirements. A. Buffer Requirement. The City of Little Canda prohibits local registration of a new cannabis business on a premises with a property line within 500 feet of the property line of any of the following: 1. School 2. Daycare 3. Residential Treatment Facility 4. An attraction within a public park that is regularly used by minors, including a playground or athletic field. B. Zoning Requirement. The City’s Zoning Code identifies where the variety of cannabis businesses defined by the state of Minnesota can locate with the city. Land which is outside of the minimum buffer requirements established in Section 827.050 may still be ineligible for all or some cannabis businesses depending on the assigned zoning designations. 827.060 Local Registration Application. A. Application Submittal. The City of Little Canada shall issue a local retail registration to a state- licensed cannabis retail business that adheres to the requirements of Minn. Stat. 342.22, and which qualifies for a registration under the provisions of Chapter 827. 1.
