Lane and Che audi.ence a proposed grid plan <br />proposal f.or the area and pointed out that there would be addi.tional streets <br />(Cont.) i.n the area i.n the f.uture. <br />Mr. Licht pointed ouT, that hSr. Lane is not only request:i.ng the <br />buildi.ng permit for the garage, but the expansi.on of an existing <br />il.l.egal body shop. Mr. Licht informecl the Council that the busi.ness <br />has existed at this Location for a long per.iccl of ti.me. The I~uildi.ng <br />Inspector identitied the use and suggeseed that Mr. Lane bring tliis <br />inatter before the Counci.l.. <br />Mr. Lane reported that he did not have a job at one po:i.nt, theretore, <br />he created his ocan job. <br />Hr. Pahey statec.i thaL the Counci.l cannot apply t:he ordinances to <br />some people and not to others~ even if Mr. Lane's neighbors do not <br />object to the body shop. Mr. Pahey stated that Lrom the City's <br />standpoint it would be the wrong thin~ to do. Fahey felt the <br />di.f.fi.cu].t question was ~ahat to do with the exisCi.ng use. <br />Mrs. Sca].ze pointed out that others wi.ll say that it Mr. Lane can <br />operate a body shop in an R-1 area, ~ohy can't they. Scalze commented <br />that i.f the CiT.y allows Mr. Lane to <lo this, it will have to allow <br />everyone the same right. <br />A member of the audience pointed ouC the electr.ical company 7.ocated <br />on County Koad D. Mrs. Scalze reported that th.i.s property was <br />zoned light industri.al. Mr. Porsberg commented that that particular <br />property should not have had Light industri.a7. zoning. <br />Mr. Pahey stated that as long as neighbor;; do not complain he does <br />not get excited about people doing body worlc in their garages. <br />Mrs. Nardini. reported that there was a complai.nt in this instance, <br />and the 13ui1ding Inspector went to check it out. <br />Mr. Licht stated that the Council's policy is critical in this matter, <br />as the Ci.ty staf.f bases their di.recti.ons to people on Council policy. <br />Mr. Licht reported that in this situat:i.on the proper procedure was <br />not f:ollowed. Mr. Li.cht stated that the Council should chanPe the <br />ordinance i.L Chey deci.de that this situati.on is acceptable. <br />Mr.s. Nardini. reported that she received a call from a lep,iti.mate <br />bus.i.nessman on this subject who operates a similar type operation <br />i.n the proper zoning. Thi., man was concerned about thc~~ competit~ion <br />that Mr. Lane presenCed and felt this competi.tion was un£ai.r. <br />Mr. Flanson aslced how the Ci.ty can say ~it i.s O.K. for one person <br />to operate their business wi.thout the property zoni.ng and then deny <br />another. <br />Mr. Pahey agreed that people must be treated consistentl.y. <br />Page -11- <br />
