HOUBE LOCATED ON TRACP B SU~JPCT 7'0 T'lIP <br />PLANNER'S RFCOMMENDATIONS CONTATNED IN It:[S REPORT <br />The f:oregoi.ng resoluti.on was duly seconded by Mrs. Scala.e. <br />Ayes (5) Tahey~ Scalze, I-lanson, Nardini, Porsberg. <br />Nayes (0). <br />Resol.ution decl.ared adopted. <br />'Phis resolution appears in Resolution I~ootc No. 9, Page 195. <br />A& W Matter P1rs. Nardini informed Mr. Bode of the A& 6d that the City previousl.y <br />allowed the temporary addit.ion to the A& W bui.ldi.ng. Tkie City has <br />Additions learned that it did not h~ve the r~i~ht to allow this under the UI3C. <br />'Co The A~enda <br />Mr. Forsberg reported that the City's agreement with P~r.. Bode was <br />thaC the adctition was f.or a one year peri.od and if determined <br />successful, a more per.manent structure would be installed. <br />Mr, 13ode commented that he d~ict not i.nvest $15,000 inCO a t:emporary <br />struct:ure. Mr. F3ode stated t:haC he uncterstood that there ~oas no <br />dvubt i.n anyone's mind that the structure was permanent and not temporary. <br />Mr. Porsber~; reported that the structure i.s not bu:ilt to cocle and there <br />are no f.ootings under thi.s structure. <br />Mr. Pahey reported Chat the City wants the temporary structure brou~;ht. <br />up to code. <br />Mr. Porsber.g commented that the City cannot allow Mr. 13ode to operate <br />a business i.n cahich people are coming into a structure that has no <br />f.ootings under. i.t. Also there was never a permit pulled for the st:ructure. <br />Mr. }3ode repl~i.ed that he cannot: afford to put more money ~i.nt:o the <br />structure. Mr. Rodc stated that he thought the City's onl.y concern <br />was f.or the addi.tional exit to the property. I3ode r.eported thaC the <br />owner of. the property wi11 not a11ow this exi.C and that he :i.s only <br />the leasee of the property. <br />Kr. Pahey asicecl Mr. Bode i.f he were goi.ng to cooperate with the City <br />and bri.ng the buildin~; up to code. L'ahey stated that the Ci.ty wi.11 <br />need an i.nspection of the properCy made by the 13ui.lding Inspector. <br />Mr. Fahey stated that the Ci.ty will not tcnow cohat. is necessary t:o <br />bring the bui.ldi.n~; up Co code wi.chout an inspection of the property. <br />P4r.
