March ?1 he attempted to <br />respond to the concerns rai_sed at the Planni.ng Commi.ssion meeting. <br />Mr, DeLonais, Planni.ng Commissi.on Vice-Chai.rman, reported that t:he <br />Plaiming Commi.ssi_on assumed that t_he matter would be returned to them. <br />The PLanner pointed out that the Planning Comm'i.ssi.on has 60 days to <br />respond to a matter and if. no acti.on is tat<en i.n that time, the <br />deci.sion is up to the Council. Mr. Hanson asked iL the Council weis <br />bound to return the matter to the Planning Comm~iss:i.on. <br />Mr. Pahey, i.n revi.esvi.ng the ordin<+nce, poi.nted out that the ordinance <br />provides that a conditi.onal use per.mit shall not be ~ranted until the <br />Council. has r.ecei.ved a report from the Planni.n~ Commission, or 60 days <br />have elapsecl since the mr.itter went bef.ore the P7.anni.ng Commi.s<.;ion. <br />Mr. Pahey sugYested that the Council hold the hearing on the matter <br />and then return it to the Planni.ng Cornmission. <br />TQr.. Mark McCul.lough, Attorney repr.esent:ing Mrs. Petersen and Mr. <br />Villeaux, appeared befor~ Che Council. Mr. N[cCull.ou~;h request:ed that <br />the Coimcil dismzss the Nardini rezoni.n~; petiti.on.
