MINUTES <br />CITY COUNCIL <br />DECEMBER 18, 2024 <br />There were no further comments from the public. Upon motion by D. Miller, seconded by Kwapick, <br />the public hearing was closed. Ayes (4). Nays (0). Motion adopted. <br />Mayor Fischer welcomed input on whether daycare and residential treatment buffers should be <br />included or excluded. D. Miller commented that he would support excluding those uses from the <br />buffer requirement to better match alcohol and tobacco sales. <br />Kwapick asked if Ordinance 902 should be tabled to allow staff to bring back additional information <br />on where the State -licensed facilities are located. Mayor Fischer asked if that would cause an issue. <br />The Community Development Director commented that the ordinance could be adopted as it would not <br />be effective in essence until an application is received. He stated that he can bring back additional <br />information in January. Gutierrez stated that they could also specify commercial daycares versus in - <br />home daycares. <br />The Community Development Director confirmed that they could add language to specify that the <br />buffer would only apply to daycares and residential treatment facilities within commercial districts. <br />He stated that the ordinance could be adopted with that additional language or Ordinance 902 could be <br />tabled to January. Gutierrez commented that there are other cities adopting no buffer from those uses. <br />She asked the distance from Happy Trees to the school. The City Clerk stated that business is closing <br />at the end of December. Mayor Fischer commented that is a special -use school that chose to move into <br />an industrial area. He recommended postponing action on Ordinance 902. <br />The City Clerk stated there was only one or maybe two commercial daycares in the city. Kwapick <br />stated that he would agree to match the buffers for alcohol and tobacco. The Community Development <br />Director noted that the buffer is mentioned in Ordinance 902 and 905 and therefore recommended that <br />action be postponed on all items until January. <br />D. Miller introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2024-12-147 — TABLING CONSIDERATION OF ORDINANCES 902, <br />903, 904, AND 905 TO JANUARY <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (4). Nays (0). Resolution declared adopted. <br />ORDINANCE 906 AMENDING ZONING CODE CHAPTER 917 TO ADD INTERIM USE <br />PERMITS <br />The Community Development Director provided background information on interim and conditional <br />uses. He presented information on the proposal for Interim Use Permits (IUP) and how an IUP could <br />be used specifically for cannabis businesses. He also provided details on another minor edit proposed <br />related to the timing requirement for submitted applications prior to a Planning Commission meeting <br />date. Staff recommends approval of the ordinance and summary publication. <br />Mayor Fischer opened the public hearing for comments from the general public. <br />5 <br />
