MINUTES <br />Ci.ty Counci.l <br />July 10, 1985 <br />North Oaks <br />Auto Sales - <br />Auto Repair <br />License <br />Agenda <br />Item No. 6 <br />North O~lcs Auto Sa1es has requested an auto repair li.cense to locatie a <br />business at 3165 Spruce Street. As the properCy is properly zoned, ehe <br />City staff is recommending approval oI the license. <br />Mr. Collova introduced the following resoLution and moved its adoption: <br />RESOLUTION N0. 85-7-329 -APYROVING TIIL <br />AU'CO REPAIK LICENSL' AS R~QU~STED I3Y NOIYL}I <br />OAKS AU'CO SALPS <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Ayes (4) Collova, Nardini, 131esener, Pahey. <br />Nayes (0). <br />Resolution decLared adopted. <br />'Phis resolution appears i.n Resoluti.o^ I3oolc No. 12, Page 334, <br />Zil.~e/ Mr. Kobert DeBace appeared before the Council and submitted the <br />Del3ace Def~ace/Zilge p1at. DeBace reported that ehe plat is unchanged Lrom <br />Plat the last Counci.l meeting. Mr. DeBace requested PUD approval as we11 <br />as plat approval. <br />Mr. Lowell Renestran of Capital City Glass appeared before the Council <br />Renestran is the leasee of Outlot D, which is owned by ~Ir. Del~ace. <br />Renestran reported that his business has expanded and the reason <br />for the PUD request is so that Mr. De}3ace can build a 40 by 100 <br />foot Uuilding that Renestran can rent iro~n DeIIace in additi.on to his <br />present building. Renestran repor.ted that at some point he wishes <br />to purchase the property. <br />Mr. Fahey pointed out that there is a 30% Limitation on the size oL <br />accessory buildings. Pahey stated that i.t was unfortunate that the <br />Council did noC have this informaCion sooner than it di.d. <br />Nardini pointed out that there is curr.ently a five foot si.deyard <br />setUack at CapiLal Ci.ty GLass and there should have been a 15 foot <br />setbaclc. The 1?lanner pointed out that this property is included in <br />the Ryan Industrial Yark PUD. <br />Narclini stated tkiat there were no variances granted in the Capital <br />City Glass development proposal. <br />Mr. John 13urton, representing Mr. Dellace, appeared before the Council. <br />Burton commented that a variance is being requested to allow a 4,000 <br />square foot building on cuhat is designated as Lot 1 on the proposed <br />plan. 13urton stated that no ordinance covers every situation and <br />pointed the unique property thaY is being discussed. Burton pointed <br />out that there is freeway preventing access to [he baclc of this proper.ty <br />and also po~ver lines adjacent Co the property.
