MINUTES <br />City Council <br />Septe 25, 1985 <br />SLeneroden Mr. Paul H~ram9 owner of Lot 16, stated that the property he owns was <br />Yroposal used as commercial since the time it was built. <br />(Cont.) <br />Mr. Schrier stated that he had a problem wiL-h the proposed street running <br />into Sylvan as there are commercial properties on the new street and <br />he did not want commercial traf£i.c on Sylvan. The other F~roblem that he <br />had was that if the street we~~t through, he would be left with two <br />corner lots and development on the lots cvould be restricted to a 40 foot <br />wide house where currently he coulct build a 45 f.oot wide home. <br />Fahey asked Schrier if he would object to the proposal if the City rezoned <br />the commercia~L property to R-1. Schrier stated that he would prefer no <br />additional traffic on Sylvan. Schri.er f.elt that the proper way for Che <br />development to go would be out to Rice StreeC. <br />Mrs.ScaLze felt that peopLe alon~ the new street may oppose a downzoning <br />of their property. <br />Fahey felt that perhaps it was better to leave the property 13-3 and go <br />out with the road to Rice Street. Fahey pointed out that the Co~ncil <br />would have to have a public hearing on any downzonin~. Fahey stated <br />that he wouLd like to know how these people might feel about a do~anzoning. <br />P1r, Pierce commented that most of the peopLe who own this property are <br />elderly. <br />Mre Townsley sup,gested that I.ots 11 and 22 be combined and Che B-3 <br />continued down Rice Street the same depth that it is now. <br />Mrs. Townsley pointed out that Lot 22 was up for sale last fall. <br />Mr. Kon Maddox appeared before Lhe Council repr.esenting the Stenerocten <br />proposal. Mr. Maddox stated thal i.n 1977 Mr. Schrier addressed the <br />Council caith his development about the same items that he i.s now <br />addressing the Council against this proposal. Maddox staCed that the <br />deveLopers coould be agreeable to taking the property through condemnation. <br />Maddox reported that the property on Rice STreet i.s for sa1e, but at over <br />five times wha[ it is actually worth. Maddox also stated that they tried <br />to purchase property from Schrier,but he is not interested in sellingo <br />Maddox stated that Rice Street will be even more commercial. i.n the future, <br />Maddox aLso stated that they ~oere wiLling to restrict Lot 11 so that onl~ <br />an office building could be built on it. They wi11 also ~uarantee that <br />Lots 1 through 10 remain residential. Maddox stated that they have tried <br />to come ~p with a lo~,ical way Co develop this property. <br />Mr. Schrier pointed out that when he was developin~ his property, he had <br />access to a public right-of-way. <br />Mr< Fahey commented that the Council will. have to wrestle with Che problem <br />o£ condemnation and it looks Like that is what wi11 have to be done in <br />any event if the proposal is approved. <br />Page -14- <br />
