Nayes (0), <br />Kesoluti.on declared a<lopted, <br />Thi.s resolution appear.s in ]3esolution I3ook No. 1'2, Page 484. <br />Ui.clc Boss :C~.CI Mc< Dick lloss III appeared before the Council. requesCing preliminary <br />Plat plat approval, Mr, Iloss reported that he has met with the County <br />surveyer and the house on the pxoperty is actually located on the <br />Agenda dedicated a1ley~aay, The surveyer felt that there would be no problem <br />Addition with the replat from the County's st~ndpoint, <br />Mrs< Scalze asked i.f. fioss had contacted the F.xaminer of Title. 13oss <br />replied that if there :is a problem, it would be hi.s problem. Ilowever, <br />Boss felt that there ~aould not be< <br />Iloss astced £or concept approval of the plat and once that is obtained9 <br />stated that he ~vouLd have a survey done, <br />I3oss pointed Chat the house has been in existence Lor almost 50 years <br />and k~as been bou~ht and resold over the years without a problem, <br />Aoss stated that he i.s ~ailling to agree to a condiCion that he tear <br />down the house within six years. <br />Mrse Scalze asked if the house pays taxes when it is sitCi.ng on an alley~aayo <br />Boss replied that taxes are paid on Ch~ housz. <br />'Phe City Attorney stated that from what he sees, the house has nothing <br />to cto with the property Co be platted. <br />Mr. Aoss stated Chat he ~oouLd be willing to post a bond that the house <br />will be removed within si.x years. Fahey stated that if the house is <br />not removed, the City can do it and assess the cost against the propertye <br />Mr< Gene Fasciana pointed out that the house sits on three feet of his <br />property. Fasciana asked if the house would have any eff.ect on ttte <br />development of his propertye Mr, Pahey felt that Y.here is no effect <br />from a City standpoint. IlLesener agreed that he would treat the situation <br />as if the house were not there, <br />Fasciana stated that he is not asleang £or any special consi.deration, <br />just assurance that his property could be developed even wich the <br />existance of the housee Pahey assurecl Fasciana thaC the Council would <br />not hold the existence oL the house ag~:inst him, <br />t~ahey requested that the minutes reflect that it was Che Council's opinion <br />that the presence ot the house on the Pasciana E>roperty o~ouLd not be an <br />impedi.ment or prohibition on any development Mr, Pasciana might have< <br />Page -20- <br />
