MINUTES <br />City Council <br />Nov. 13, 1985 <br />Assessment <br />Reapprtion- <br />ment (Cont.) <br />Mosted & <br />Johnson <br />Properties <br />Agenda <br />:~tem No. 11 <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Fahey, Blesener, Scalze, Collova, Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 12, Page 568. <br />The City Attorney reported that he has received a list of conditions <br />from Mr. Johnson for the sale of his property. <br />The City Clerk pointed out that the assessments are paid on the property <br />that the City wishes to purchase. <br />The Attorney also pointed out that Johnson does not want the sale <br />of his property contingent upon the sale of the Mosted property. <br />The Attorney further reported that Mrs. Mosted has ordered an <br />appraisal of her property and they will talk to the City again when <br />the appraisal is done. <br />The Attorney asked the City if it planned a public hearing on the <br />purchase. Mr. Fahey reported that a public hearing has been set <br />' for November 26. <br />Fahey did not feel that the City could remove the contingency regarding <br />the Mosted property. The Attorney stated that if that is the case, <br />Johnson wants the earnst money increased. The Attorney stated that <br />he did not know if Johnson understood that if the sale does not go <br />through, the earnst money would have to be returned. <br />Sweeney also reported that Johnson wants the use of Noel Drive for <br />his trucks. It was pointed out that Johnson has been using Roel <br />Drive for years. The Engineer stated that Johnson wants to be able <br />to use the road even when there are road restrictions on. <br />Fahey did not feel that the City would be able to allow this. <br />The Attorney further reported that Johnson wants $86,500 for his <br />property and the City offered him $81,000. It was the concensus of <br />the Council that the City stay at the $81,000 figure. Dlardini <br />pointed out that the City's appraisal of the property included the <br />lot that Johnson wants to keep. <br />The Attorney further reported that Johnson wants to retain a 100 by <br />184 foot piece of property in order to square off his property. Fahey <br />did not see a problem with this. <br />The Attorney~,ointed out the condition regarding special assessments. <br />Fahey stated that the only assessment would be on the property fronting <br />on Noel Drive and the City would.not pay these assessments. However, <br />the City would be willing to waive any assessments on the back property. <br />Page -14- <br />
