MINUTES <br />City Council <br />Jan. 14, 1987 <br />Minutes Mr. Blesener reported that Resolution No. 87-1-8 of the January <br />(Cont.) 5, 1987 Council meeting minutes should be amended to include the <br />name Bill Blesener, rather than Beverly Scalze. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-1-14 - APPROVING THE <br />MINUTES OF THE JANUARY 5, 1987 SPECIAL <br />COUNCIL MEETING WITH THE AQOVE OUTLINED <br />CORRECTION <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Scalze, Blesener, Collova, LaValle, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Dook No. 17, Page 14. <br />Vacation Mayor Fahey opened the public hearing on the proposed vacation <br />Of Portion of 8 feet of right-of-way on the north and south sides of Al1en <br />Of Allen Avenue from Ontario Road to Greenbrier Street. <br />Avenue <br />Right-Of-Way <br />Mr. Don Tarnowski, 3003 Greenbrier Street, appeared before the <br /> Council. Tarnowski stated that he was opposed to the improvement <br />Agenda of Allen Avenue between Ontario Road and Greenbrier. Tarnowski <br />Item No. 4 stated that if the City does vacate the proposed right-of-way, <br /> he being an adjacent property owner, does not want this right-of-way <br /> property as it will give his property enough square footage that <br /> he would have a second buildable lot and could be assessed for the <br /> improvement of Allen Avenue. Tarnowski pointed out that the <br /> assessments would be in the neighborhood of $10,000. Mr. Tarnowski <br /> also reported that he has discussed this matter with the Attorney <br /> General and was informed that the City could not force him to <br /> accept the 8 feet of property should it be vacated. <br /> Mr. Tarnowski reported that his property is 90 feet wide by <br /> 221.65 feet deep, and when he purchased the property the 66 foot <br /> right-of-way for Allen Avenue was in existence. <br /> Tarnowski reported that if the right-of-way is vacated and Al1en <br /> Avenue improved and in the future he was willing to accept the <br /> additional 8 feet of property as well as the assessment for the <br /> property, then the Council could decide at that time whether or <br /> not to offer him the vacated property. <br />The City Attorney agreed that the City could not force the adjacent <br />property owner to take title of vacated property. However, the <br />City would file a Certificate of Completion of Vacation, and then <br />the County would make a determination of what to do with the <br />property. <br />Page -2- <br />
